ENTIRE HEALTHCARE BILL
THROWN OUT
BY FEDERAL JUDGE

In his ruling US District Judge Roger Vinson wrote, "Because the individual mandate is unconstitutional and not severable, the entire act must be declared void."

He goes on to make reference to the Boston Tea Party:

"It is difficult to imagine that a nation which began, at least in part, as the result of opposition to a British mandate giving the East India Company a monopoly and imposing a nominal tax on all tea sold in America would have set out to create a government with the power to force people to buy tea in the first place. If Congress can penalize a passive individual for failing to engage in commerce, the enumeration of powers in the Constitution would have been in vain for it would be 'difficult to perceive any limitation on federal power' , and we would have a Constitution in name only."

This is a big victory in the ongoing battle to defeat this terrible bill. Once again we have made history together. It was pressure from us that brought this case to court and saw it through to this point. The influence of Tea Party Patriots is undeniable. Congratulations!

1. they can't even get their facts right on the Boston Tea Party.
why would anyone take them seriously if they are so confused and wrong about the incident that supposedly inspired their name?

2. I want to see the exact clause in the Constitution the teabaggers are relying on
I'm sorry, young teabaggers, but there is nothing in the Constitution that prohibits the government from passing a law requiring you to buy something.

I think they're relying on the Takings Clause of the Fifth Amendment, but it says nothing about private property, in this case money, being taken by a corporation.

3. Damn - I thought they were ALWAYS wrong
"there is nothing in the Constitution that prohibits the government from passing a law requiring you to buy something."

The first thing I've ever heard the Tea Party be right about. Constitutional quibbling aside, this is not an appropriate thing for a government to do.
