6 year old charged with felony sex assualt
thats right a 6 year old has been charged with a felony for playing doctor with a 5 yr old girl..
the kids parents are suing the DA in federal court seeking 12m in damages

5. its high time we limit
a prosecutors power.. in addition any prosecutor who repeatedly convicts people later proven innocent should have to serve as much time in jail as those she convicts

6. I hope they win.
The poor kid has had medical procedures that required rectal exams. Of course he thought it was "normal" for a doctor to do. I can understand a school being concerned and asking questions. I can understand police investigating the facts. I can't understand how a DA, after seeing the facts, could file charges against a child so young he has no idea he did anything wrong and for who a rectal exam is "normal". Damned DA should be charged with criminal douchebaggery and fired.

I'm not a psychologist but isn't normal for kids that age to start being curious about the bodies of other children? That's when they start going to kindergarten and meeting different people. Boys start to recognize girls are different.

I can't believe a DA would even consider this as a case or a grand jury would indict. A 6-year-old is completely incompetent to understand the consequences of their actions. Otherwise they wouldn't steal all those cookies or write on the walls with crayon.

I hope the judge excoriates them all - especially the parents who are obviously well-connected.

And that stigmatized child may likely need counseling after the stupid tempest in a teapot dies down.

So the suit for $12 Mill should balance out OK since the DA has that much time and money to spare.

Don't think kids can't be guilty of sexual assault. It indeed does happen.

just as they can steal and murder and drive cars.

But can the behavior of a child this young be felonious? Can you prove a child this young can form criminal intent or did the child act with a child's known and legally recognized lack of knowledge, reason and impulse control?


When a human is a minor - especially this young - it would be difficult to prove the child had adequate intellectual ability - comparable to that of an adult in the same circumstances - to discern right from wrong. And that's just the first hurdle in this case.

The child needs help, but the prosecutor is obviously making an "example" out of this child.

19. I don't think anyone believes underage children are incapable of the essential act.
But in order to be a functional society, we have to give a certain amount of leeway to children on a lot of things, maybe not everything, but definately a lot more than we should give fully grown, mentally capable adults. Children discovering their sexuality is a natural process and a lot of them, of course, start discovering it before they're ready to handle it responsibly.

Now in the case of your story, when one child forces another child to do something sexual, thats a violent act, whether it was sexual or not. Whenever children engage in violence, they definately need to be confronted and attended to and, at a certain age, should undergo some consequences (humane ones of course).

The entire premise of age of consent laws is that a child is not capable of understanding the consequences of their actions in sexual matters. But no one - absolutely no one - would claim a six year old is capable of understanding the consequences of their actions. This is insane. The prosecutor should be in jail and registered as predator. Because this a predatory abuse of a small child.
