Lawyer: Bullying Led To Shooting In Waikiki (Federal agent in Hawaii for APEC)
Edited on Mon Nov-21-11 03:52 AM by dkf
HONOLULU -- The federal agent charged with killing a Kailua man at the Waikiki McDonald’s restaurant nearly two weeks ago made his first appearance in court Thursday morning, while his attorney said he was acting in self-defense.

Brook Hart, the attorney for Christopher Deedy, 27, said his client was protecting himself and others when he shot 23-year-old Kollin Elderts to death.
"Mr. Deedy was the one attacked. He defended himself," Hart said.

The Medical Examiner's office said Elderts had marijuana and cocaine in his system when he died and his blood alcohol level was 0.12, higher than the legal limit to drive.

Hart said Deedy stepped in when he saw Elderts "aggressively bullying someone else" at the McDonald's at about 2:30 a.m. Nov. 5. Deedy was at the McDonald's with two friends, who Hart would not identify.

1. This is that 2nd degree murder charge that happened right before APEC.
It looks like the accused showed up for court. Some were suggesting he'd leave the island.

They have the whole thing on video. I guess there were a lot of cameras in the McDonald's.

The family of the dead man has already initiated a civil suit, ahead of his criminal trial:

3. Doesn't justify shooting him even if it is true.

In a McDonalds none the less. The Fed was drunk and stupid. Why is he trying to do the job of HPD?

4. Well Deedy did have a broken nose and an injury to his jaw.
I think he thought giving Elderts warning shots would scare him away but the guy was high on coke and pot and drunk too so he went after him.

And is a federal agent supposed to stand on the side if he sees someone in trouble? I think the article said his friend got slashed.

5. Self defense and defense of another is certainly justified.

7. Well the local guy was still unarmed.
Apparently the knife at the scene was Deedy's.

But there is more to the story than a sweet innocent and harmless kid being shot by a murderous federal agent.

6. That's very different information from what first came out.
There were all kinds of rumors flying initially; that the guy who got killed was happy and cheerful, not causing any trouble; that he was shot without provocation; that they had initiated an argument at a club and one followed the other to the fast food joint; that it was a grand conspiracy and the accused would be spirited off-island, never to return....etc., etc.

I thought there absolutely HAD to be factors in mitigation for the guy to be charged with 2nd degree. If, as some were saying, the guy pulled out his weapon after a tiff, and shot the guy in cold blood, that would have warranted a stronger charge as well as no bail or very high bail.

I have no idea what happened, but this case interests me. I'm betting those videos tell a good piece of the tale.

10. Lotta rumors flying.
He didn't look injured in his mugshot. No bruising or swelling evident...nor did he look injured in court. We're just going to have to wait and see.

8. And what was Deedys blood count? Blame the victim again is not gonna work this time
Deedy asked the kid if he wanted to die...kicked him to provoke....both went into fighting mode on the ground when Elderts was shot....he was unarmed....

Deedy is guilty of killing a kid because he was a BULLY carrying a WEAPON....he was on a mission to BULLY

12. Sounds like Elderts was going off on the public though.
I have a friend who is a cop and I swear he told me he is supposed to keep his gun around when off duty just in case this sort of thing goes on. He made me hold it for 2 seconds once in his fanny pack. I was very uncomfy as I don't like guns and a little bit wary at the thought of him having to step in when we hang together.

9. I'm curious to know what was in Deedy's blood system that night
Of course inconvenient questions like that will only cloud the 'official' narrative....
