1. There's the rub...
state prosecutions are not "Offenses against the United States", they're crimes against the state. See Article X.

He should have used the bully pulpit...but he had no pardon power.

5. If your point is that Obama could have pardoned Troy Davis or commuted his sentence...
you are mistaken. This section of the Constitution has consistently been interpreted as giving the president power to issues pardons and commutations in federal cases. His power does not extend to state cases.

there was no other federal crime committed during the shooting.

The Troy Davis case was a state case not a federal case.

President Obama had NO jurisdiction.
