Officer who had sex on car fired by NM police
APAP – Sat, Sep 3, 2011

SANTA FE, N.M. (AP) — A New Mexico state police officer has been fired after security cameras caught him having sex with a woman on the hood of a car.

Officer Bert Lopez's dismissal from the New Mexico state police was confirmed by The Santa Fe New Mexican (http://bit.ly/oIqKyd ) on Saturday. The newspaper said Lopez has 30 days to appeal the firing.

The surveillance photos were taken from a motion-triggered security camera positioned at the front gate of the county-owned La Bajada Ranch south of Santa Fe. The encounter was at the remote Canyon Ranch.

I'm actually very pro-sex. It's the waste of time...but not on the taxpayer's dime, not in public, and not in uniform.

On edit: I see the point to be made concerning 'it's only sex.' After all, far worse offenses go unpunished with great regularity.

112. The video tape only proves sex took place. The other accusations have not been proven,
and the investigation said no crime was committed, and therefore, no bribe took place according to the police.

I fully admit the police could be lying to protect their own, they seem to this often in my perspective, but the woman could be lying too. Humans lie a lot.

13. I used to work in a grocery store.
If my boss had caught me on the security camera having sex in the stockroom, I would have fully expected to be fired. Hell, if a police officer found ME doing what that guy was doing (going at it right out in broad daylight, in public) I'd have been arrested!

Police officers are held to a higher standard than grocery store clerks, because they serve as role models and public defenders, and they have access to sensitive places and situations--like private homes and violent crime scenes. We need to be able to trust that these men and women are trustworthy, serious, and have a more accurate moral compass than the average person on the street. Behavior like this proves that this man is not fit to be a police officer, no matter what awards and honors he'd won in the past.

And I know I'm probably in the minority here, but I do NOT believe that the woman would have "consented" if not for the fact that she had just been pulled over. I heard her radio interview. I know she said that the sex was not to get out of a ticket. But we have no clue whether or not she might have been trying to minimize the backlash because she'd been threatened or otherwise coerced.

He deserved to be fired at the very LEAST, and he ought to consider himself lucky that he didn't end up charged with a crime over this. He abused his position and failed to live up to the higher social standards that we hold our police officers to, and perhaps even committed a form of rape. We'll see what the woman says now that the guy's been fired and no longer has any authority to retaliate against her and her family.

The PHOTO shows him in uniform--that means he was on the job. When we put people into positions of public trust in that way, we do it with the understanding that they will be held to a higher standard than an ordinary person. I don't give a crap who fucks who in terms of private employment, but cops, judges, public schoolteachers and elected representatives are expected to behave according to a higher standard. They KNOW this when they sign up for the job--they agree to it in order to be trusted with that kind of power and authority.

If you don't like the social contract that public servants enter as a condition of employment, then quit your fucking job and go be a truck driver or a Wackenhut rent-a-cop, or better yet--don't apply for that job in the first place. You don't get to behave like a toddler who possesses neither willpower nor restraint and still keep that kind of public trust. If you're someone who thinks birth control pills are evil, then don't be a pharmacist, and if you're someone who thinks breaking the law and acting like a 14-year-old jackass while on the job is a great idea, then don't be a fucking cop.

And of COURSE he exploited his authority while on the job. How else would he even have MET this girl, if not for the fact that he had the authority to pull her over? Would she have agreed to having risky sex in broad daylight, right out in the open on the hood of her car, if he'd been just some random guy in normal clothes that she happened to meet? I seriously doubt it. Whether the girl consented or not is irrelevant to the question of whether or not he exploited his position. People who have power are very good at getting weaker people to technically "consent" to an abusive, exploitative situation.

Not to mention that he broke the law, and cops should be the LAST ones we tolerate lawbreaking from. So far as I know, having sex right out in the open like that is still considered a sex crime.

middle of the night a young couple came and had sex in the pool...I thought it would be bad karma to narc them out, so I watched quietly from the office, unseen...A few days later I got fired for NOT calling security, lol...

It was a shitty job anyway -- easily one of the worst in my life...

In some circles, this is the equivalent of the police officer raping her. In other words, despite what others on this thread have written, this was not just (consensual) sex.

This story was posted about a week ago, and in that post, there was a link and audio clip from a local radio station who interviewed her. The woman said she had been pulled over for speeding in a remote area w/very little traffic. She admitted to having sex w/the officer because 'men in uniform turn her on' (or something to that effect- paraphrasing here)

Anyway, at the end of the interview (which btw was sort of a joking/lighthearted kind of thing) the woman, who did not allow the station to use her name, was asked if she still ended up w/a speeding ticket after the encounter. "Of course not" she said, laughing.

I'll see if I can find the link since the interview seems to conflict w/the statement in this yahoo account of the incident. See below... I wonder if these "investigators" agreed not to use her name in exchange for her not talking about the case any further, because her account clearly implies that the sexual encounter kept her from receiving a traffic ticket. That (imho) would mean the officer accepted a bribe.

The dismissal came days after investigators said the officer didn't commit a crime. Officials were assured the sexual encounter was not in exchange for anything related to his position as a law enforcement officer.

"It is an embarrassing situation for the department, but we have to remember the rights of the employee afford him due process we must follow so we won't be commenting further," said spokesman Sgt. Tim Johnson.

The department refused to release the identity of the woman or details about her relationship with the officer.

At the very least, this man was not doing his job--that taxpayers PAY for--on "company time". And then add to the fact that he is a police officer with a code of professional conduct to uphold. And then add to the fact that it appears he accepted a bribe. And then add to the fact that this gal could have been a criminal looking to disarm him and cause some trouble. So, so many reasons why he needed to be fired. I am pretty sure that in ANY job I've ever had, I would have been fired if caught or filmed having sex in a break room or supply closet.

Allowing that type of conduct from cops puts a target on everybody's backs that come across a rogue cop. No fear of punishment means that a rogue cop can ask for sex to not cite a citizen for a variety of offenses that a person should get and pay a ticket for, or go to jail for. is that whether we think cops who kill innocent men, women, children and family pets should go to jail for a long time, they do not. They don't even have to cover it up. Their superiors will do that for them.

When that changes, then yes, someone engaging in sexual behavior while on the job should be held accountable, maybe a suspension for several months without pay. But there is no comparison between his behavior and the long list of crimes committed by the police that are never punished.
