The NEW LABOR DEMOCRATS

Back when I was demanding a third party/progressive party it was from pure hate from what both the Republicans are doing and the current panty waste Democrats have done to our Country. After further study and consideration I have come to the only absolute conclusion that can/would/should/needs to be done if we are going to take our Country and Constitution back from these Oligarchs.

As the TEA Party did internally forcing national attention to the Republicans and garnering political capital through Demonstrations and Votes...

So should WE...

We need to forment Nationally a SUB Party within the Democratic party called the LABOR DEMOCRATS!

Not to sign pledges or maybe so, to get the point across that the 77% of the peoples of the United States, You Know, the ones that work for a living...are not going to take this bullshit any longer and will vote in LABOR Democrats that will agree with a platform of fair taxation across the economic spectrum, a demand that all incomes pay into social security not just the $150,000 and below incomes...dissolution of off shore tax loop holes, the end to subsidizing coal, oil, gas and nuclear industries, NO privatization of PUBLIC Services or Resources, trade/tariff protectionism to stimulate Domestic manufacturing, Minimum wage protection from these bastards that want the American workers to gut the standard of living we have created over the past 200 years and make us live under third world wages... and more...here is the platform I have been working on..your mileage may vary as do your opinions...please don't shoot the messenger just tell me what you don't like...



PREAMBLE CERTIFICATION ACT. 1.A) Acknowledging that this was the preface and Origins of INTENT of the Framers of the Constitution, and that, ALL interpretations of the Constitution's Laws and Provisions should be interpreted from the intent expressed in the clauses stated within the preamble. Currently it is rumored...Conservative Justices even some on the current Supreme Court have argued and won in court, the belief, that the Preamble has NO Bearing on the interpretation of the Laws and Provisions written within the Constitution! 1.B) Acknowledgment that the Constitution is a SECULAR non-denomination document and NOT a Christian document as some historical revisionists are attempting to claim.



CITIZENS RIGHTS ACT. Repeal the Un-Constitutional Patriot Act.



FISA RESTORATION ACT. Dump Patriot Act provisions and Enforce FISA Rules for all foreign intelligence investigations.



TAX EQUITY ACT. Flat tax of 15% for all Private individuals earning $20K or more Exemption only for the 100% disabled, the elderly on Social Security income only or individuals over the age of 67 with individual income under $100,000. Flat Small Business tax of 17% for all small business or corporations of 30 employees or less. Flat Corporate tax of 23% for all business's or corporations with 31+ employees. Zero tax exemptions allowed for business or corporate location, relocation, construction and development. ZERO Tax exemption for Business or Corporations that maintain their equity and funds overseas to avoid US taxation for goods and/or services produced within the territories of the US. 5% tax on all consumable goods. 7% tax on all luxury items. 8% tax break on all alternative energy projects that produce zero sum air, water or soil pollution in the generation of energy.



IMPORT SECURITY ACT. 12% tariff on ALL imported goods not originating from a 51% owned US business or corporation. ALL businesses and corporations willing to be designated a US Business or Corporation and exempt from the tariff MUST always be a minimum 51% US owned and must maintain an additional 10% of their stock with the US Government. These stock interest monies in turn would be exclusively for US owned small business development loans from the US Economic Board. Yes giving the Government of the Nation of the US a stake and small voice in the corporations. Socialism? NO! Nationalism YES. Corporations will NEVER invest or reinvest with the American people as long as we have a higher standard of living than anywhere else that they can make a higher profit from...this is the nature of Laissez-Fair Capitalism! And this is the Elephant in the room with Capitalism, the search for maximizing profits at the expense of any government, anything or anyone else. I for one love this country more than any other that I have visited, I would prefer we as a Nation endure and not become a slave Nation to the Corporations of America and the Financial Elite NOR be reduced by these said entities to a Third World UNEMPLOYED weak economic populus begging for scraps from the Government. IF the Government owned stock option is totally rejected then all business should be taxed at 23% and corporations should be taxed at 28% with NO loopholes in the tax code for them to avoid supporting our Nation with their taxes. Additionally all products shipped into the US whether complete, in total, in pieces or partial goods would be subject to the same 12% tariff unless produced and shipped from a US designated factory or in the instance of raw materials a Mine or land Tract owned by a US Corporate entity.



REPRESENTATIONAL TERM LIMIT ACT. 2-Term "Consecutive" Term Limit for all Senators and Congressmen.



TRUTH IN GOVERNMENT ACT. End to Anonymous Holds of presidential appointments. If you place a hold you must be identified with that hold and you must within 30 days justify the hold or remove it. With a 90 day maximum filibuster delay to a vote of proceeding to confirm, deny or removing the appointment. End to open filibuster rules. Filibuster initiators should be REQUIRED to actually be PHYSICALLY on the floor and stay there as the filibuster was originally intended. An Individuals filibuster should be able to be broken by a minimum majority vote, Political Party Filibusters willing to overturn the minimum majority vote should require 100% of one party and an additional 5% of another party to be valid. This rule should end political gamesmanship at the expense of the American people.



JUDICIAL CONTROL ACT. Term limits for Supreme Court Justices of 12 years. The Presidential ability to request a vote of no confidence, censure or removal against a Supreme Court Justice for partisan violations of impartiality... (Citizen United vote was not even on the Supreme Court calendar, they brought it to themselves to vote on it) ...voted on by a super majority of the Senate. If a Supreme Court Justice is removed from office using the Presidential no confidence rule they are barred from any direct governmental or lobbyist position for life. Additionally all Supreme Court Justices must adhear to the Judicial Responsibility and Integrity act already in place that all other State and Federal justices must adhear to.



FINANCE REFORM ACT. Campaign Finance Reform with Full donation source reporting. Corporate Donation financial limits the same as an individuals and swift prison terms for influence peddling for lobbyist firms and the government official convicted of selling their vote for profit. There is no reason a Corporation should have the ability to pour more money into a campaign or Government Representative than any individual of "WE THE PEOPLE."



TECHONOLOGIES SECURITY ACT. US Patent Sale restriction of 10 years to force National development of technologies rather than selling our new technologies future to the other Nations of the World. Patent licensing restriction for 2 years to US owned companies exclusively.



CONTRACTORS UCMJ ACT. All Contractors under contract for services with the United States Government or one of its Entities operating outside the Territories of the United States will be under and subject to, the UCMJ Code of Conduct, its procedures and penalties and have a DIRECT Military or Governmental Liaison responsible for the documentation and reporting of Violations to the Designated Chain of Command for action from infractions. Never again should rape, murder and negligent deaths by a contractor go un-punishable by the US Government.



NATIONAL EARTH ACT. Requiring all industries to be responsible for 100% of their environmental impact study and clean-up. Too long industries have polluted our Earth and then left it on the backs of the American people and their Government utilizing a Waste cleanup Superfund. Included would be industry requirements of impact studies with plans for zero permanent damage to our watersheds, soil and air. Either we are parasites on this Earth killing the hosts to our own detriment or we can be healthy symbiotes renewing the Earth for all generations.



NATIONAL LANDFILL RECYCLABLE ACT. ALL government owned landfills will be allocated monies and in the case of privately owned landfills, long term low interest loans shall be allocated to convert from solely burying refuse to a Hybrid Recycling Center Landfills and Energy Power Generation Plants. Recovering electrical power from the conversion of waste products. In the instance of Government owned Recycling Centers ALL monies recovered in the recycling process and Energy Generation shall be allocated to operation expense and to IN-STATE Transportation Projects Exclusively.



NATIONAL WATERPOWER RECLAIMATION ACT. ALL government owned water and wastewater treatment plants will be allocated monies and in the case of privately owned water or wastewater treatment plants long term low interest loans shall be allocated to convert from solely treating water or wastewater to a Hybrid Water or Wastewater Energy Power Generation Plants. Recovering electrical power from the conversion of wastewater to Methane, Hydrogen, clean water and solid wastes. Any monies generated from government water treatment power generation shall be allocated to operation and maintenance expense and to IN-STATE Transportation Projects Exclusively.



PARITY IN SENTENCING ACT. Assessment and restructuring of sentencing for non-violent crimes and drug violations to increase fines and reduce prison sentencing. Refocus of the Drug War on Prevention, Recovery and Treatment rather than Arrest, Seizure and Detention. Reclassification of mild drug use, not distribution, such as Marijuana use to be a misdemeanor and fines in line with alcohol rather than treating these passive users harder than rapists murderer's and thieves.



VIOLENT CRIMES ACT. Increased RECOMMENDED Sentences for Murder, Armed Assault, Kidnapping, Rape, Sexual Assault, Sex Trafficking and Pedophilia including and up to the Death Penalty for Repeat Offenders.



JUDICIAL CONFIDENCE ACT. Judicial Prerogative on sentencing, removing the Mandatory Minimum Sentencing requirements.



ACCELERATED TERMINATION ACT. Streamlined procedures for Judicial Review of Death Row executions for inmates and habitual offenders where there is definitive proof of guilt including Audio, Video and/or verified and reviewed DNA evidence In States that accept the Death Penalty Sentence.



FJVAA ACT. Federal Judicial Victims Assessment ACT. Requiring the opportunity of additional Primary and Secondary Victim impact statements on all Violent Felony Crimes addressed to the courts and additional penalty and fines imposed to the convicted from the Judicial review of said statements. Currently each State weighs impact statements differently and some courts or judges do not accept or require them for proceedings. This should at least allow the victims continuing impact be made part of the Courts Record and where applicable, the Public Record.



TRUST IN LAW ENFORCEMENT ACT. Mandatory every 2 year psychological evaluation of all Civilian Law Enforcement personnel with a public review board overseeing evaluation reports.



TRUST IN THE JUDICIARY ACT. Mandatory every 4 year psychological evaluation of all Supreme, Federal, State and Local sitting Judges with a public board or Bar Association overseeing evaluation reports.



SECURITIES PROTECTION ACT. Restoration of the Glass-Steagall Act. Restore the provisions that prohibit a bank holding company from owning other financial investment companies which were repealed on November 12, 1999, by the Gramm–Leach–Bliley Act. Also the Restoration of Regulation Q which allowed the Federal Reserve to regulate interest rates in savings accounts repealed by the Depository Institutions Deregulation and Monetary Control Act of 1980.



NET NEUTRALITY ACT. Denying any content provider or backbone from creating a multi-tiered pay to play network, stifling content and access.



NATIONAL ONLINE PREDATOR ACT. Making it a Federal Sex crime to stalk, track, harass and demean individuals with the intent to cause damage to their reputation or to incite or cause physical or psychological harm to a person.



NATIONAL ANTI-STALKING ACT. Making it a Federal Sex crime to stalk, track, harass and demean individuals with the intent to cause damage to their reputation or incite or cause physical or psychological harm to a person.



CONSUMER PROTECTION ACT. Formation of the Consumer Protection Agency with ability to fine, shutdown or foreclose on predatory lending institutions and their Parents or Subsidies.



EQUITY IN THE MILITARY ACT. Repeal of DADT.



CITIZENS EQUITY ACT. Constitutionally mandated marriage and cohabitation benefit equality for same sex couples.



EEOC QUOTA DISSOLUTION ACT. The end to EEOC Provision of Racial quota systems in favor of merit and performance review.



FDIC REVISION ACT. Increased powers for the FDIC to investigate and prosecute violations of the FDIC Act.



EPA REVISION ACT. Increased powers for the EPA to investigate, prosecute, shutdown and fine violators.



FDA REVISION ACT. Increased powers for the FDA. to investigate, prosecute, shutdown and fine violators.



FCC REVISION ACT. Increased powers for the FCC to regulate, prosecute shutdown and fine violators.



TRUTH IN BROADCASTING ACT. Restoration of the Fairness Doctrine in Broadcasting and making it a crime to knowingly and intentionally lie to the American Public.



HOMELAND SECURITY DISSOLUTION ACT. Repeal of Dept. Of Homeland Security. Dissolution of the bloated and redundant Department of Homeland Security and refocus of National Security with the already existing combined terrorist joint task force of the FBI and NSA.



TERRORIST PROFILERS ACT. Authorize Constitutional legality of Racial profiling of "Enemies of the State" and their secondary suspects in anti-terrorist prevention investigations with the required backing of a FISA warrant.

NATIONAL DATA SECURITY ACT: All business, companies, corporations or government entities are required to have a firewall and an access recording system for ANY system that may have or may access any data pertaining to US Infrastructure including Transportation, Water, Electrical, Energy Generation, State Agencies, Military Installations, Federal Facilities, Federal Agencies, Government Product Development Entities and Military Contracts. All entities must show proof of security of their systems to a Government Assessor or face loosing contracts, financial incentives and possible prosecution for flagrant repeat violations. The governmental entity responsible for this inspection should be the FBI Cyber Terrorism Division with the cooperation and assistance of the NSA and NTSB.

Well there it is folks, please don't attack just to attack, I am open to any and all changes after all this is just a platform I am working on...

Pay no attention to the Obama supporters behind the curtain.
They know Obama can't win without the Progressives. If we formed a new party, he's pretty much finished. They will poo-poo anything having to do with Progressives leaving the Party. They don't like us, but need us to win.

This is a GREAT post, BTW. I still need to finish reading it, but just needed to give you props for all your hard work. :thumbsup

I completely agree we need a NEW Progressive Party.

11. OK (along with a K&R) here is what I think
I think you have a very good idea. I also accept your list of policies as legitimate and well worthy of consideration or at least open discussion. However - you knew it was coming - I do have one thing to say. It strays to far afield from policies that will be of immediate benefit to labor. While I endorse most (can't buy into that eminent domain thing on the borders for instance) I don't think they capture the tone of the name, and that is important to my mind.

I am afraid that will have to be done by smarter people than myself. I just was trying to paint the broad strokes and hoping others would continue to add their thoughts and ideals such as yours so that we can focus it more precisely. I do not claim to be a smart person, just an angry one...

:)

With your suggestion and the one above about removing 5-8 perhaps that would focus it better?

18. Yours is a thoughtful post...hopefully leading to a rational discussion.

TAX EQUITY ACT. I am uncomfortable with the flat tax.
I believe those who benefit most from our system should pay a higher percentage.
I believe a goal of the flat tax is to simplify the tax code,
removing special credits aimed at specific corporations and industries.
I don't think it follows, if one has a flat tax, these special credits will be removed.
Republicans will argue the special credits are needed to benefit business.
Instead of arguing for a flat tax I would suggest arguing to close all tax loop holes.

IMPORT SECURITY ACT.
I see two problems with a tariff directed at corporations that aren't 51% U S. owned.
First, we will run afoul of Trade Treaties; these will need to be renegotiated.
Second, I believe the real problem is the loss of American jobs in this country.
We need the work done in this country. We need American jobs.

American corporations know how to outsource. I don't know how serious the outsourcing problem is.
I think some claim outsourcing is a real problem while others do not; there is disagreement.

It shouldn't matter if the corporation is American or foreign.
I don't fully understand the ramifications of a V. A. T. tax, and I would like to know
if a V. A. T. tax might address the problem of workers without running afoul of Trade Treaties.

REPRESENTATIONAL TERM LIMIT ACT. I have problems with this suggestion.
I don't want Bernie Sanders term limited out of the Senate.

I believe Senators and Representatives gain much useful knowledge over time.
One of the complaints against the Tea Party Freshmen is they don't understand how government works.
I would hate for a Senator or Representative, when they finally learn how government works,
to be term limited out.

I suspect the Republicans would figure a way around a consecutive term limit.
If I were the Republican Senator or Representative, I would take my two terms.
I would go into private practice as a lobbyist, for two terms while my friend is in office.
I would go into public office while my friend became the lobbyist.

I think we need to remove Senators and Representatives the old fashioned way, with the voting booth.
Public opinion is turning against the Tea Party and its members.

SECURITIES PROTECTION ACT. I would go further.
There needs to be a way to break up companies that are too big to fail.
I don't know how to do this. I wish people would find a way.
We must never again have companies that are too big to fail.

TRUST IN LAW ENFORCEMENT ACT. I would go further.
Any person should have the legal right to video/audio record the actions of the police.
The police should not be able to hide behind any eavesdropping laws.
We give the police a great deal of power. We need a way to check the abuse of that power.

TRUTH IN BROADCASTING ACT. I like the idea making it illegal to lie to the public.
I don't know how to enforce this. I have certain beliefs, like I believe in global warming.
Others do not share my beliefs. How can I tell if they are being disingenuous or simply naive.
I don't pretend to be omniscient. I can be wrong. How do we decide what is truth and what is a lie.

NATIONAL LANGUAGE ACT.
I don't see why we need an amendment declaring English our national language.
English is our national language, by custom and usage.
English is not the only language in our society; please consider sign language used by the deaf.
Immigrants may not know our language, but their children will learn our language in school.
I wish we were more multi-lingual. I wish everyone knew multiple languages.

ILLEGALS EXODUS ACT. I thought of our country as a melting pot of many cultures.
There were times, in our history, where we were much more open to immigration.
There were other times when we were very restrictive.
I would like to hear arguments why we should restrict immigration.
Some argue immigrants take jobs. This may be true, but at least the jobs are here, not overseas.
Some argue immigrants get Social Security/Medicare/Medicaid. If they pay in, shouldn't they benefit?
I don't know what to think about this one.


NATIONAL UNIVERSAL HEALTH ACT. A public option does not go far enough.
We need a single payer, national health system. Health Care needs to be a right.
We keep tackling who pays for health care.
We don't discuss how to control the costs of health care.
We need a national health system to address both questions.

NATIONAL DATA SECURITY ACT. I agree with the idea some sort of mandate is needed, but not this one.
I worry this mandate will fail. People will get "something", as a check off, to say they have it.

Security is a dynamic process, not a one shot thing one purchases off the shelf.
I would mandate people be certified, such as www.sans.org or some other reputable certification.
I would mandate IT people be recertified on a regular basis.
I would mandate corporations and government have a plan when break-ins occur, and they will occur.
Make sure all date is encrypted. Have adequate backups. Track who accesses what data.
Have plans to deal with denial of service attacks.
Assume a break-in will occur. Have measures in place to minimize and mitigate the break-in.

21. It baffles me why sensible Americans aren't all working for the end of the two-party system
There are a large number of systems that allow one to see that a vote for a specific candidate is NOT "wasted" by taking votes away from a more mainstream candidate. It is this flaw in our system, I think, that makes Dems so much like Repubs, as much as they'd LIKE TO be different.

If I vote for the most liberal candidate, and my candidate doesn't get enough votes to continue, I want my vote to be weighted TOWARDS the NEXT MOST LIBERAL candiate. I DO NOT want it to count as a vote taken away from the mainstream liberal and given to the opposition. That is both stupid and unnecessary.

Even more than campaign finance reform, I think this (the spoiler effect) is the single largest problem with American politics at this point.

25. Does not apply in a federal election. The Presidency can be decided by a plurality, not
a majority vote.

On the other hand, many states do require a majority vote for state offices, same with many local offices.
