I can't believe fucking Florida
My life Partner passed away in 2006 his son My step-son was killed in 2003 We had custody of Davids son phillip for four years that we had to pay Davids ex-wife child support (through the State of Florida) for phillip (this was from 1996 to 2000).

I get a check in the mail today for David that The State owed us for child support that we were forced to pay when we had the child. The checks in Davids name.

I'm fucked again!

14. I was wondering if someone had power of attorney, or executor of the estate
or possibly even survivor rights as next of kin


There must be some reasonable avenue for you to be able to cash that check

Although, even if the worse did happen and you got caught forging the signature I can't believe any prosecutor would want to put you in front of a jury.

Rick Snott has reduced the state payroll so drastically there probably aren't any people left to follow up on this sort of thing.

7. Financial Matters Get Taken Care of in Deceased People's Names All the Time
Is there an estate? I would think the estate executor or administrator should be able to provide a legal signature. If not, ask whether you might have standing to be considered for that role yourself. If one of those options works, it's certainly easier than trying to deal with the state government yourself.

Whoever was legally responsible for David's estate should be able to endorse the check over to you. If you were in charge of the estate, you should be authorized to endorse it.

But you might want to check with a lawyer to make sure.

He may take $3000 of it, but it's better than nothing. (unless of course you can deposit it and keep it all)

15. Were you your partner's legal beneficiary?
In essence--did he make a will and leave his estate to you? Because if he did, the check is part of that estate and as such, you should be able to file a claim and get it re-drafted in your name.

Call a lawyer.
