New court filing reveals how the 2004 Ohio presidential election was hacked

July 19, 2011

A new filing in the King Lincoln Bronzeville v. Blackwell case includes a copy of the Ohio Secretary of State election production system configuration that was in use in Ohio's 2004 presidential election when there was a sudden and unexpected shift in votes for George W. Bush.

The filing also includes the revealing deposition of the late Michael Connell. Connell served as the IT guru for the Bush family and Karl Rove. Connell ran the private IT firm GovTech that created the controversial system that transferred Ohio's vote count late on election night 2004 to a partisan Republican server site in Chattanooga, Tennessee owned by SmarTech. That is when the vote shift happened, not predicted by the exit polls, that led to Bush's unexpected victory. Connell died a month and a half after giving this deposition in a suspicious small plane crash.

Additionally, the filing contains the contract signed between then-Ohio Secretary of State J. Kenneth Blackwell and Connell's company, GovTech Solutions. Also included that contract a graphic architectural map of the Secretary of State's election night server layout system.


Prior to the filing, Cliff Arnebeck, lead attorney in the King Lincoln case, exchanged emails with IT security expert Stephen Spoonamore. Arnebeck asked Spoonamore whether or not SmarTech had the capability to "input data" and thus alter the results of Ohio's 2004 election. Spoonamore responded: "Yes. They would have had data input capacities. The system might have been set up to log which source generated the data but probably did not."

93. Keith, together with David Schuster, reported extensively on Countdown in 2004
and asked the hard questions regarding the long lines, the lack of voting booths in Democratic heavy areas, the over abundance of voting booths in Republican strongholds, and even followed Senator Barbara Boxer who stood with the CBC to protest the electoral college count in January 2005.

He was the ONLY one who did.

GAB, Kathy Nicolas and crew have had some new software created for such occasions as to put in Ron Johnson, Prosser, Walker and other AlEC Bots.... Please let me know if any legal aciton will be taken to stop election fraud.... Right now I wish I had information explaining Barbara Wirth's complaint about how a March 30 voter receipts was calculated before anyone voted on the machines? Then I want to know how many of those votes were for Prosser.... Thanks...

What we saw in 2000 was simply a reversal of those new powers!!


The smaller voting computers were coming into Florida in the late 1960's and two Florida

journalists began to investigate the unlikely and unverifiable election results --

They also passed their info on to Larry O'Brien at the DNC in the Watergate building --

the information was left for him as he wasn't there at the time.

This was just before "Watergate" --


They had a contract for a book which was delivered to book stores and then immediately

removed from the shelves. It's available here and there for $3 a copy --

and/or you can read it at the website --


I'd question every election back to Nixon/Humphrey --

I don't think there ever was a "Southern Strategy" -- I think there ws only the computers!

though! Remember even Barbara Boxer came over from the Senate to the hearings? We were all here on DU doing "running threads" from C-Span to watch it all. Those were the Good Old Days... When we still had HOPE and BELIEVED. It was an interesting time.

(ohio has 88 counties) . We had great faith that we could expose what occurred to the world. Very few in the media would even bother to examine the evidence. So sad that ignoring the evidence has lead to this huge mess.

Instead, about three miles short of the Akron-Canton Airport, Connell's plane crashed to the ground in an upscale section of Lake Township, killing Connell instantly. "I was standing in the kitchen and I looked out the window and all I saw was fire," Taylor Fano told The Akron Beacon Journal. "It took out the flagpole and the cement blocks surrounding the flagpole . . . . It skidded across the driveway and right in-between a line of pine trees and a small fence around an in-ground pool."

The Federal Aviation Administration is investigating the accident and has not yet filed a report, but there was no immediate evidence of wrong-doing or sabotage.

Many in the blogosphere have called for further investigation of the crash, suggesting that Connell was about to provide crucial information in the case of alleged vote fraud in the 2004 Ohio presidential contest, and that that information would implicate Karl Rove and others in the Bush administration.

I'll never forget that day. Never. I was an election judge that day. The lines were incredible. The excitement was palpable. Even though it was a long, long day, it went by quickly. I got home just after 9pm MST & they had just announced PA for Kerry & it was looking good in OH. The high I felt was wonderful!

And then, just like that, it went from looking really good for Kerry to Bush. It was freaky. And within a very short time they called it for Bush & I knew the American people had been cheated out of their votes once again. I went to bed in tears & called in sick the next day. And yes, I was genuinely sick. I cried most of the day.

Even though it won't change anything, I would love for the world (& those fucking repubs) to know that we Americans did our job - we voted Bush out, but our votes were stolen.

on edit: The USA is quickly rotting from the head down. I don't know how we can save it, but I've lost all confidence in the electoral process.

I didn't like what John Edwards did either. It was SLEAZY and STUPID. I was real disappointed. But I can't say he's a whole lot worse than a many many others and I think it's real sad that this party is wasting his talents.

Those of us in the IT field heard about this at least 5 yrs ago. When the IP address of the vote (holding) server changed at 1am, that was the first clue. That doesn't happen unless someone changes it. That election has fraud written all over it. Didn't they make a documentary about that...why yes, I believe they did. Too bad I can't remember the name of it.

Michael Moore would be proud.

I wrote this to myself in 2002, after doing some digging that was way over my pay grade.

In late 1997, a corporation that had consisted of a solid business in auto parts outlets and industrial supplies began to suddenly buy up companies related to voting machines and election services. The company was Tyler Corporation and the CEO was William Oates, founder of Business Resources Corporation and CEO of Business Records Corporation, which he also started. Tyler Corporation purchased Business Records Corporation in 1998, and Oates replaced Fred Meyer, a Dallas man whose credentials include chairmanship of the George W. Bush inaugural, chairmanship of Victory 2000 (the Bush fundraising campaign) and a Bush family crony for many decades. Tyler Corporation changed its name to Tyler Technologies. According to expert Eve Waxtell, Tyler had/has financial ties to Cronus Corporation, which had purchased companies controlling 80 percent of the voting systems (CES, Thornber, and Governmental Data). There are crossover members of boards of directors between Cronus, Tyler, BRC and other entities in the elections services business.

Here's where it gets interesting. After buying an enormous share of the elections business starting in late 1997 and installing Oates (an elections old hand) as CEO, Tyler started dumping this segment in December 2000. Oates left then. I've lost my notes on the stock sales, but I was following some records of insider trading. C.A. Rundell, CEO of Cronus and a director of Tyler, dumped 65,000 shares of Tyler stock in December 2000, for example. The corporation that went from an auto parts business to elections services and installed a CEO with elections experience began to sell all that in December 2000.

Oates is now (2002) the CEO of another new firm that specializes in data collection for government entities; other directors of that company have Cronus and Tyler ties, and all began at Eastman Kodak, which dabbled in election services until scared off by fraud litigations in the 1980s. Fred Meyer is now the CEO of Aladdin, a company he served for many years earlier in his career (he's now 73).

Is there a story here? Some questions beg to be answered. Why did Fred Meyer leave Tyler in 1997? Did he remain a de facto force? Was Oates hand-picked by Meyer?

It would seem that Tyler Company/Corporation was used as a front in order to gather physical control of a vast segment of election services through the 2000 election. It would seem that Fred Meyer stepped aside (at least in name) because he was too close to the Bushes and the Bush campaign.

I have no background in mergers, acquisitions, the corporate world or the stock market. Some of these corporations have changed names, been bought out, bought up, stopped and re-started, merged, etc. There probably are a lot of ways to track more information that I'm just not familiar with. It is true that things are not always what they seem (skim milk masquerades as cream) but the trail begs following, IMO. The implications are staggering, if the story pans out.

whopping 17 point lead on Bush Sr after the Democratic Convention, it's hard to say a 17 point lead can be wiped out by a commercial showing black prisoners going in and out of prison instantly. They ran a really sleazy campaign against the very respectful Dukakis, and it was pretty close, but I suppose Bush won, but knowing how they steal thousands of votes, and block thousands more from voting, it honestly was a toss up. They know nothing but corruption! Their last obvious victory was Reagan's 84 landslide.

I hope Rachel covers this, but frankly, there won't be much talk about this at ALL on TV.

136. Please let this finally come to light
I have a feeling that with the fall of Murdoch, the over reaching of the wacky tea party republicans in MI, OH, WI, FL etc., and the willingness of republican to push the country over the economic cliff that Americans are reaching the breaking point. If this story were to rise to the level of general awareness, and Americans became aware that none of this was necessary, that they've be had at every turn, things might just get interesting. We just might stand up and demand the reforms that will give us a responsible government and news media.

143. Here's the problema
as I see it. Most of the people receive most if not all their news from mainstream corporate owned media. If these media ignore a story it's like it doesn't exist. The minority who access other sources of information can safely be ignored, marginalized or discredited by mainstream media. The question becomes how to make alternative media the new mainstream media.
