NYT reporting on Carlucci and News Corps payments in US
Troubles That Money Can’t Dispel

Time and again in the United States and elsewhere, Mr. Murdoch’s News Corporation has used blunt force spending to skate past judgment, agreeing to payments to settle legal cases and, undoubtedly more important, silence its critics. In the case of News America Marketing, its obscure but profitable in-store and newspaper insert marketing business, the News Corporation has paid out about $655 million to make embarrassing charges of corporate espionage and anticompetitive behavior go away.

In 2009, a federal case in New Jersey brought by a company called Floorgraphics went to trial, accusing News America of, wait for it, hacking its way into Floorgraphics’s password protected computer system.

News America was led by Paul V. Carlucci, who, according to Forbes, used to show the sales staff the scene in “The Untouchables” in which Al Capone beats a man to death with a baseball bat. Mr. Emmel testified that Mr. Carlucci was clear about the guiding corporate philosophy.

So what became of him? Mr. Carlucci, as it happens, became the publisher of The New York Post in 2005 and continues to serve as head of News America, which doesn’t exactly square with Mr. Murdoch’s recently stated desire to “absolutely establish our integrity in the eyes of the public.”


Meanwhile another branch of Murdoch's media, the WSJ, puts out an editorial trying to put a lid on the U.S. reporting of this. Marcy Wheeler has a great analysis:

OMG, this is hysterical. Remember when Eliot Spitzer got nailed on a bogus criminal charge that implied he kidnapped a teen hooker?

In braying for politicians to take down Mr. Murdoch and News Corp., our media colleagues might also stop to ask about possible precedents. The political mob has been quick to call for a criminal probe into whether News Corp. executives violated the U.S. Foreign Corrupt Practices Act with payments to British security or government officials in return for information used in news stories. Attorney General Eric Holder quickly obliged last week, without so much as a fare-thee-well to the First Amendment.

The foreign-bribery law has historically been enforced against companies attempting to obtain or retain government business. But U.S. officials have been attempting to extend their enforcement to include any payments that have nothing to do with foreign government procurement. This includes a case against a company that paid Haitian customs officials to let its goods pass through its notoriously inefficient docks, and the drug company Schering-Plough for contributions to a charitable foundation in Poland.

Applying this standard to British tabloids could turn payments made as part of traditional news-gathering into criminal acts. The Wall Street Journal doesn’t pay sources for information, but the practice is common elsewhere in the press, including in the U.S.

Yep, and when Fox and Post news crews were at the residence of the teenage girl before the police when they were trying to drum up an underage aspect to the Weiner situation (which failed):

Wheeler's piece is also very good since she gives info on the Wall Street Journal Rachel also referenced and on the Guardian bringing the NYT onto reporting the issues.

Be sure to look at Wheeler's blog as well. She does a great job of pulling much of this together, along with providing insight on The Guardian going it alone on the reporting at first and then persuading the NYT to join in.

She also has key parts from the Wall Street Journal Rachel just referenced, a link to that and great analysis of it.
Really important piece from her.

14. Yes, really have to credit the people at the Guardian for plugging away
at this.

And it was interesting to see Rachel key in on the two aspects I keyed in on early today.

Did you see the thread yet about the items retrieved from Brook's trash?

Now, that will be fitting payback if they find something from the computer, papers and phone since digging through other people's info was so long her zone.
