"Don't Talk to the Police"
by Professor James Duane

http://video.google.com/videoplay?docid=-4097602514885833865&hl=en#

Haven't seen this posted here in a while - good information.

there's a part two presented by a law enforcement officer who agrees and explains some techniques he uses to get people to talk.

Innocent or guilty, if you are arrested, there is no good reason to talk.

4. Yes it does. Initially, it was hard to wrap my head around this idea -
I'm in my mid 50s and was raised in a small lily white town.

That was the era of "the policeman is your friend" and it's what we grew up on.

5. Another recent thread:

That made me think of the Arizona 'Bust Card' put out by the ACLU in response to AZ's passage of SB 1070 (the 'Papers, please' law):

6. If I hadn't talked to the police
I might still be behind bars, from an incident several weeks ago, where I was "busted" for having pot, and being slightly inebriated at a waterfront park celebration with live music, etc.

They barely said a word to me, but I was a chatter-box, nostalgically rambling on and on about how sweet it was "back in the day" when police would typically escort such a person as myself home, where they are safely deposited for the night, while also not wasting taxpayers money to incarcerate someone for such minor indiscretions.

To my utter amazement, they drove me home.

I submit this not to disagree with the premise: "Don't talk to the Police"; but merely as a friendly reminder that like every generalization, there are also stark exceptions to the rule.

11. I don't think a minor marijuana bust or a speeding ticket is the point.
Activists, on the other hand, should never talk, should never permit law enforcement into the home. Unfortunately now, if you let an undercover agent into your home, you lose your right to deny entry to the FBI. But then again that was last year, with the warrants gone, it might not even matter.

Chart:
speeding or weeding in a locality where it's not a felony: it's okay to chat the police up.
feeding homeless people, organizing against the death penalty, or like activity: don't talk.

10. The video of the cop
who comes after the professor is interesting as well. He talks about some of the tricks the police use to get a suspect to talk and he talks about how the deck is stacked against a suspect.

14. Here's A Handy Catch-Phrase To Remember.................
.............brought to you by your friendly neighborhood criminal defense attorney.

When in doubt, just remember this catchphrase: "Don't give them the rope to hang you with."

And if you're ever in a situation where you're unsure about ANYTHING, don't guess. Always ask to speak to an attorney first. It's your Constitutional right to do so. Exercise it.
