Get $15 in Rice Krispies class action settlement (no proof of purchase required)

You don't have to show a proof of purchase to claim $15 in a class action lawsuit against Kellogg. Just be someone who bought Kellog's Rice Krispies or Cocoa Krispies between June 1, 2009 and March, 1 2010.

The lawsuit contends that the cereal maker falsely advertised that the two cereals supported your immune system even though it didn't have adequate data to back the claim.

35. I'm 68 years old! Somhow I don't think they're talking about somneone
who bouht them that many years ago. I don't know exactly why this suit was file, but my guess is that there was some claim about healthy, or reduces heart disease, or something like that, and back in the 50' people didn't even think that way. Sorry. I won't do it. It feels dishonest to me.

36. I have. I use them also to make treats. I use marshmellow creme
rather than melt marshmellows because its so creamy. I wish I had a nickel for every box I've ever bought including the dozens I bought since the dates stated. Thank you for this, OP. You are a good soul.

43. never said it was healthful. :) I find them once or twice a year good
for the soul. As for the health benefits or not, I just like to eat them with bananas. I guess at my age its okay. think of it as a future space for someone else to occupy when I go to the big cereal bowl in the sky. :-D

16. The details of the settlement are that Kelloggs admits no wrongdoing.
They are basically just handing money out to their customers because they got caught defrauding us. I don't really remember why I bought cereal a couple years ago, but I know I bought the shit because of specifically remembering how good it was to eat a favorite old cereal when I had been sick prior to that.

The terms of the settlement are such that people who bought Rice Krispies are entitled to the money, not just people who bought it for the immune system claim. ie. You are entitled to the money; if you don't want money you are entitled to, that's your business, even if you are foolish.

once you add the milk. Rice Krispies are one of my all time least favorite cereals for both those reasons. And the cost of cold cereal is absurd... one of the reasons I stopped buying any of it ages ago. Once I became allergic to dairy products I stopped eating cold cereal the traditional way anyway and only liked to have some occasionally as a dry snack... even then I bought the store brand stuff in a bag rather than any of the crazy expensive name brand stuff in a box.

I've always thought of cold cereal as more of a kids type breakfast anyway though even as a kid I would have rather have had something else.

In 2009, the state of Oregon complained to Kellogg that they said Rice Krispies and Cocoa Krispies were fortified with antioxidants, and Kellogg changed the description of the boxes of the cereal—though the cereal is fortified with antioxidants. Almost immediately, several plaintiffs' lawyers filed lawsuits on the basis of Kellogg's announcement, and after several amended complaints, Kellogg's agreed to a nuisance settlement of $2.5 million. Class members can request $5 refunds for up to three boxes of cereal purchased between June 1, 2009 and March 1, 2010, an amount that will be reduced pro rata if the settlement money runs out, though one might expect that there will only be a few thousand claims. Though the class is nationwide, Kellogg is giving another $2.5 million (retail value, so it's really costing them half as much) in food to two local charities in Santa Monica and Atlanta. The class representatives will seek $5000 each.

How much are the attorneys asking for? I don't know: it's not in the notice or settlement agreement, but it comes out of the $2.5 million settlement fund. (The attorneys will announce on July 18; objections must be received by July 25—a Monday. This abbreviated and substandard notice is arguably a violation of Rule 23(h) and Ninth Circuit procedure in In re Mercury Securities Litig.. The notice is otherwise substandard, as there are several hoops one must jump through to object that are not listed in the notice.) Anything left over after the class is paid will go to the two local charities and a trial-lawyer group.

Nobody here is suggesting that anybody who did *not* buy either of the two cereals during the specified time should file a claim. Kellogg has agreed to pay the $5 per box to people who *did* buy the cereal. So where does "fraud" come into play here? :shrug:

41. Kellogg will pay this money no matter if 1 or a brazillion people do this.
If NO ONE fills out the form, they will pay this money. No matter what. If they chose to then "jack up prices", it has no relevance on anyone filling this out. They have been penalized and are trying to figure out where the money should go.

Is this so difficult to understand?

55. When local foodbanks send out a plea, when my Church begs for donations to the food bank because the
stock is dwindling? damn right I have a problem with anyone profitting in this. The Lawyers should've taken this on pro-bono, Kellogg's should've just decided to settle and all monetary awards go directly to food banks. I don't see a problem with my view at all. Go look at empty shelves at the foodbanks and the Churches and look at the people coming in looking for food, and tell me with a straight face that anyone should profit off of this?

lawsuit Kellogg's will jack up the prices, I would've preferred it didn't come to this at all where a lawsuit was started, but since it has I'd at least prefer all the money from Kellogg's and the millions most likely in lawyer fees to be donated to foodbanks.

Now can I ask you to join me in solidarity by asking that the lawyers waive their millions in fees and donate along with Kellogg's to foodbanks?

Kellogg has agreed to create a fund of $2.5 million to be used to pay first Class Counsel’s attorneys’ fees and expenses awarded by the Court, then a class representative incentive award of $5,000 to each of three class representatives, and finally the claims submitted by Class members. Any money left over will be donated to one or more charities. Kellogg also has agreed to distribute to charities that provide food to the indigent certain Kellogg branded food items having a total retail value of $2.5 million.

39. The right thing to do would've been a private settlement where the makers of Rice Krispies
would donate millions of dollars in cereal boxes to food banks which are hurting in these difficult times. And I would hope that any progressive that signs onto this would do the right thing and if they receive money in a settlement they would donate to those who are worse off.

To think that corporations shouldn't be responsible for fraudulent claims. Perhaps when doctors are successfully sued for malpractice, we should have them merely donate to charities rather than the woman who lost the wrong breast. Surely there are many worse off than she.

Certainly it's your choice to not claim your money (and as such that part of the money will go to charity, so good for you) but here's the terms:

4. How can I get a payment?
To receive money from this settlement, you first have to determine if you are a Class Member.
Class Members are those persons who purchased Kellogg's Rice Krispies cereal or Cocoa Krispies cereal in the United States between June 1, 2009 and March 1, 2010. Excluded from the Class are Kellogg's officers, directors and employees, and those who purchased Rice Krispies or Cocoa Krispies for the purpose of resale.

Why you bought it during that time isn't the point.

and not asking anyone, not advising anyone, to commit fraud. How many people keep receipts for a yr from groceries? Good grief people, look at this as passing on info to those for whom it applies. If it doesn't apply to you, ignore it. If it does and for some odd reason you don't keep grocery receipts for 2 yrs, you can still apply for this.

about doing this. I will file for the money because I buy RC on a regular basis, in fact I have two huge boxes sitting on top of my fridge right now. I will then write to Krispies Class Action Settlement administration and tell them although I buy this on a regular basis I had to take a guess about the date etc and if this is in any way going to affect the charitable giving that I want to opt out but I would not mind the refund if it is appropriate under those circumstances. The opt out address is Krispies Class Action Settlement Admin c/o GCG, INc PO Box 9732 Dublin Ohio 43017-5632. I will let them decide. On edit I attached a RC proof of purchase to my note too.

to do what you suggest. In fact, it would be seriously unethical for anyone to do what you suggest, unless they meet the requirements.

I realize that you included the requirements in your post, but the emphasis on the "no receipt" thing makes it seem like you're encouraging people to behave unethically.

75. Again, nobody is suggesting that anybody file a claim unless they meet the requirements.
The reason for mentioning that no proof of purchase is required is so that people who bought the cereal understand that it's OK that they did not hold on to their grocery receipts from two years ago.
