Boy did Fox News Fuck Up

Clicking through the news channels and Fox was having their in house legal expert comment on bringing prosecutions to New York. Despite all the baiting by the fill in host he absolutely decimated all the arguments against bringing them here.

His name is Arthur Aidala and it will be interesting to see where he ends up after destroying Fox's talking points

1) Federal Prosecuters have a 99% conviction rate. New York has the cream of the crop. If the career prosecutors have looked at this and are on board bringing this to New York that means that they have a ton of 'untainted' evidence.

2) The security arrangements in New York are the best. The Marshals and Court Security have had many other high profile cases and they will have no problems handling it.

3) The jury pool will not work for the defendents advantage.

4) They have experience Federal Judges that will not allow it to become a propganda affair.

After he destroyed the idiot host in detail Aidala was asked wasn't there a few 'loose cannon' judges around that might be outmanouvered?

Aidala looked at him and said with a firm voice, "I practice in New York and there are no 'loose cannon' federal judges. These guys are going to get a fair trial. They are going to be found guilty on the basis of evidence and then I hope we don't execute them because that's what they want'. I hope that we put them in solitary confinement for the rest of their lives - that would be real torture for people who think they are missing paradise."

He was better than any of the guys on CNN or MSNBC - Fox really screwed that one up, who is the producer in charge of vetting the guests?

35. I think you're wrong on MSNBC. Look at Maddow, Schuster..........
..........Lawrence O'Donnell and contributors like Eugene Robinson, Howard Fineman and Clarence Paige. It ain't perfect, but what is? It's a hell of a lot better than when they dumped Donahue and were trying to imitate Fox back in 2002-4. Back then everybody referred to them as "MSGOP". I'm not cheerleading here, but WHEN I watch socio/political stuff on TV, I usually watch C-span, MSNBC or PBS usually. I'll watch Fox just to keep up with what insanity is going on with the "dark siders".

The irony is that the lawyers for these defendants probably agree with Fox and would not want their clients cases tried in NYC either. I'd be unsurprised if they filed for a change of venue, arguing that they cannot get a fair trial in NYC, given that it was the epicenter of 9/11.

But now they are all of a sudden in an uproar. Nobody seems to bring up the topic that this trial had not happened during the whole time that the Repuglicans were in power.

XM radio on long trips (when we are very bored) so that our teenagers can see how they present the news (lies). Because of fox (and some of the kids they go to school with) they've learned so much about the type of people in the republican party. I have tried not to force my beliefs on my kids but to expose them to many beliefs so they can form their own. All three are liberal but my son also has some conservative sides to him (pointed out by his conservative teachers as he discusses topics with them). I love that they have learned about all sides of an issue and can see through the bull. Example my daughter (17) saw a letter the NRA sent us trying to get my husband to join and I always send it back explaining why we would never join (then they have to pay the postal fee). She picked up the letter (propaganda) and read it and just started laughing "Is this for real? This is so hilarious. You're saving this right?". I love that she is interested in reading it and that she can see right through it. Why can't adults do the same?

51. This is what Rumsfeld said in the early days after 9-11 as a reason for going to war immediately
after the cause for going to war was being defended - when trying to get approval. No one complained or objected. A slur on the citizens of this country and a slight to the judicial system.

(Which reminds me - when is Obama going to clean up the Attorney General group loyal to the baron agenda brought to us through Rove/Bush and team that Pat Robertson sent them.

The question still needs to be answered = Why was an adviser to the President put in charge of firing AG's in this country. This is one of their jokes on humanity that Cheney didn't seem to be involved in. Cheney - foreign and corporate deals. Bush - some domestic deals - definitely not 9/11.

24. He's an analyst...he's getting paid for his opinion as much as his knowledge.
It's not inappropriate for him to express that opinion as long as it's clear that it is his opinion as indicated by his identification as an analyst; to whit, one who provides analysis.

Such convicts are kept in solitary confinement for their own protection because there would surely be many of their fellow prisoners who would delight in taking revenge upon them by killing them and making a name for themselves.

It's the prosecutor's job to "sell" his version of events. Just as it's the defenses' job to sell theirs. Neither is proven until it's over.

By this standard we could just do away with trials. Apparently you believe that someone must be guilty because they are charged, because the prosecutor never lies or make mistakes.

Federal prosecutors can and do lose trials.

We require trials exactly because of what's going on here: a mob sentiment that the accused should be hung.

I expect more from good democrats.

Yes federal prosecutors can and do lose trials, but not very often. I'm not saying I'm certain he's guilty beyond a reasonable doubt. I am saying that if they are taking the case to trial they have substantial untainted evidence.

One thing that has struck me--almost from the beginning of the Post-9/11 world--was how much Republicans and those in the "Heartland" saw THEMSELVES as the victims of 9/11. If they thought about New Yorkers at all, it was almost as if to blame them for somehow being complicit because, well, because they didn't hate Muslims enough or something?


They made all their paint-by-the-numbers pictures of crying Statues of Liberty, but had no compassion or empathy for the city of the attack.

Remember the Republican Convention, staged and timed to capitalize on 9/11 hysteria? But conventioneers were given warning pamphlets about what a horrible, dirty, crime-ladden city it was.

I remember Jon Stewart quoting some Republican during the election--something about New York going Democratic because New Yorkers just didn't understand the seriousness of the terrorist threat. The concept of "New York" being a victim of the attacks, rather than Podunk Idaho or wherever, was just not operative.

Anyway, same thing here. The city where the crime was committed is just too namby-pamby liberal to try the criminals correctly. Only Real Merkins in Real Merkin states have the right stuff to try the people who attacked . . . New York.

Any prosecutor around--Bush appointee, Clinton appointee, Obama appointee--could get a conviction on KSM. It'll be like the trial scene in Idiocracy, where the "chief J" will rip off his robe, point at KSM, and yell "Whatever, man. The guy's guilty as shit. We all know that."

But the Fox "News" legal correspondent is right: these guys really want their one night of rehabilitation, so it's better if we just sentence them to life and be done with it. The best thing would be to build a smallish prison, one with maybe 100 beds, and throw all the convicted terrorists in it. As long as they have no contact with the outside world, they can't hurt anything--and there won't be non-terrorists in there with them waiting to shank them for destroying the WTC.

To observe the contrast between a Fox propaganda clown and a serious and educated legal expert who stood up. No giggle, no stepping back, no milquetoast answer. He did not take on the role of a mr. meek as happens so often because the guest wants to be called back.

To observe how Fox is master of propaganda innuendo - referring to Federal Court judges as 'loose cannons. Planting thought in the minds of their lemmings.

To observe how a list of reasons can be presented for the good of the public. Point 1, point 2, etc. Rarely done. The counter parties amble and get off track. You wait for the next point and in a flash, they are interrupted and someone talks simultaneously - on purpose.

What I don't get is why FOX hired this guy.

I'm thrilled that this is coming to the U.S.

I will not join the parade for the death penalty. We always learn more when they stay alive, if proven guilty. We may get a case that doesn't look like the case that most people expect.

Thanks for posting. I never watch Fox, but I follow this type of story.
