4. I don't think I would charge him with a crime
I would relieve him of command and reassign him to a position that was considered demeaning for his rank and experience in some backwater post. Essentially forcing him to retire.

Alternately I would not accept his resignation, but simply fire him.

It's time for the Good General to write his book.
