Westchester County, New York Parents File Suit Against Toyota for Death of Their Five-Year-Old Son

NEW YORK, Mar 18, 2010 (BUSINESS WIRE) -- Robert J. Nelson of the national plaintiffs' law firm Lieff Cabraser Heimann & Bernstein, LLP, announced today that Nancy and Daniel Murtha of Cortlandt Manor, Westchester County, New York, filed a lawsuit against Toyota Motor Corporation for the wrongful death of their five-year-old son Jacob "Jake" Murtha.

On July 29, 2008, at approximately 9:45 a.m., Nancy Murtha, age 46, was driving her 2008 Lexus RX350 at a safe rate of speed, traveling northeast on Watch Hill Road in Westchester County, New York. She was wearing her seat belt. Her son Jake was in the back seat, properly strapped into his child car seat.

"I remember glancing in my rear view mirror and looking at my son in a car seat in the back. It was a sunny Tuesday morning in July and Jake was excited that he was going to a birthday party that afternoon," stated Nancy Murtha. Jake then asked his mother for help. Mrs. Murtha tried to slow down to pull over to the side of the road to assist him.

When Mrs. Murtha hit the brake, instead of stopping, the Lexus suddenly accelerated and careened out of control. The Lexus violently impacted a rock wall located on the northwest shoulder of the roadway. As a result of the collision, Jake suffered severe traumatic injuries and died hours later at Westchester County Medical Center.

1. What a nightmare, poor family. These law suits will escalate no doubt,

and although other car manufacturers' have survived ordeals before, (Ford), this one is truly bizarre imo. Is there anyone who understands
what the problem really is and how to fix it for good? The lack of confidence in the matter is astonishing.

I don't envy those who own one of these cars, anxiety provoking, to say the least.

On top of that, they get to finance political campaigns which given their money is better than voting.

But that story really hit me, having two young children. If that was my child I don't know how I could stand it.

6. Were the police investigators able to do an OBD-2 "read"
This, in the case of Toyota products, is a rhetorical question. OBD-2 comploant engine control computers are supposed to store information about the 5 seconds before the accident (airbag deployment) to 2 seconds after
