6. One thing that bothers me is the call for the DP...
Other than being against the DP from my core values, all death will do, (if it's implemented), is make a martyr out this guy. We should learn from the recent past, and realize than life in prison takes away any chance of "martyrdom" in the culture we're dealing with. Death brings "honor, imprisonment brings shame.

8. And it makes us as bad as the "bad people" we are executing...
.... a neat and tidy murder carried out after much debate and introspection is no better than one done in rage or with malice.

But I WOULD prefer that the poor/mentally ill that currently sit on death rows across the country be the test cases for whether or not the US should execute prisoners FIRST. If we're going to start showing mercy, we need to move some other folks to the front of the line. ;)

11. I'm against the DP for many reasons...
and I have yet to hear a viable reason for it.

It does not deter crime; it kills both the guilty, and the innocent; it actually can "benefit" a convictee by ensuring he/she does not have to "live w/the crime"...but far and away, it has nothing to do with Justice, and everything to do with revenge.

In the cases where the DP might be utilized for terrorists, (caveat: I am not a Middle Eastern Scholar, nor so I play one on TV), it is apparent that such an event would be used to recruit even more fanatics, but from what I understand, doing life in prison takes away any martyrdom, it is a terrible stigma, and not only affects the perpetrator, but followers as well. We seem to have learned nothing about other cultures, even during/after WWII and the Japanese culture became apparent.

As for the poor, and especially the mentally ill or mentally deficient...they should be the first ones with commuted sentences. Not knowing the particualrs of each case, I don't know what they should be commuted to, but the DP will solve nothing...:hi:

7. One argument that no one is making about trying terrorists in the U.S.
is that the Supreme Court ruled under Bush that anyone arrested in the U.S. must be tried by the U.S. justice system and given Miranda rights. One legal expert (Jonathan Turley?) made this point, but no one else has repeated it.

The Supreme Court is the final word on legal issues in this country, are they not? So that should be that.

9. Boggles the mind.....
.... that the patriots apparently dont have enough faith in the American judicial system that they dont feel that it is the BEST way to mete out justice for these folks. The Declaration that we hold so dear clearly says, "that ALL men are created equal," not "all Americans are created equal."

That fundamental premise is one of the reasons why this is the best nation in the world but it's meaningless unless we enforce it.

I'm just sad to see that these conservatives dont truly love America like I thought they did.
