5. The thing is that a court cannot declare a Constitutional
Amendment unconstitutional. Every amendment becomes part of what the Constitution is as soon as it is adopted. The only way to remove that amendment is through another amendment. The courts have no say whatsoever about it. This happened with prohibition. It required another amendment to remove the one that instituted prohibition.
It's very important to understand how our system of government works when you try to make a point. Constitutional Amendments are not laws. They are part of the Constitution. As such, they are beyond the reach of any court.
