Changing the Supreme Court

We all know, or should, that as long as Scalia or Thomas sits on the bench, the SC is as illegitimate as the 8 Bush years. That said, what is needed to change the composition?

Chief Justice John Glover Roberts, Jr. is 55 (DOB: 27 January, 1955).
Justice John Paul Stevens is 89 (DOB: 20 April, 1920).
Justice Antonin Gregory Scalia is 74 (DOB: 11 March, 1936).
Justice Anthony McLeod Kennedy is 73 (DOB: 23 July, 1936).
Justice Clarence Thomas is 61 (DOB: 23 June, 1948).
Justice Ruth Joan Bader Ginsburg is 77 (DOB: 15 March, 1933).
Justice Stephen Gerald Breyer is 71 (DOB: 14 August 1938).
Justice Samuel Anthony Alito, Jr. is 59 (DOB: 1 April, 1950).
Justice Sonia Sotomayor is 56 (DOB: 25 June, 1954).

Stevens retired, replaced by Kagen.

Organizing by sides and age:

Kagen, Sotomayor, Breyer, Ginsburg: Ginsburg may well retire before Obama's second term. Like with like.

Kennedy: The swing vote. Perhaps he can be persuaded by the newcomers, or other factors, to swing to truth, justice and the American way a bit more

Roberts, Alito, Thomas, Scalia: Scalis is old enough enough that he will G-d Willing need to retire in Obama's 2nd term (G-d let him choose to leave the bench sooner). Maybe some of the Thomas scandals will come to light and stick, forcing him to resign.

I don't mind a couple conservatives on the bench, as long as they're honest.

1. Scalia won't retire as long a s a Dem is in office; he'll die as an active justice.
Much as I'd like the man to do what is best for the country, he won't. His agenda is too important.

I remembered he lost consciousness a few times a few years back


I think the court needs to go to 11 members....... I know....
never happen..... but I still think it needs to.

3. 12, 16, or 20 year terms would solve this bullshit.
I'm sure others will object, but lifetime appts seem archaic.

4. I hate to say this but when the court turned was when
Marshall retired early. He was ill. But if he could have held out for about three or four more months than President Clinton could have appointed a justice and Thomas wouldn't be on the court. That would make five moderate and honest judges with the republicans having only four. The same applies that IF Clinton had had the change to appoint a justice George w. Bush would not have been APPOINTED TO THE PRESIDENCY BY THE FIVE CROOKS ON THE COURT.
