Man faces trial for allegedly having sex with girlfriend as she was dying

SAN LUIS OBISPO — Prosecutors say a San Luis Obispo registered sex offender is facing trial for sex acts with his girlfriend while she was unconscious and dying of cancer.

At the conclusion of a preliminary hearing Monday, a judge ordered 51-year-old James Wayne Leach to trial for sex abuse and other counts involving the taking of photographs of children, including naked toddlers taking showers on public beaches. Leach will be arraigned July 28.

San Luis Obispo police Detective Sue Mickel testified that Leach was caregiver for his dying girlfriend and he performed sex acts with her while she was unconscious. The detective says Leach also took sexually explicit photos of the woman while she was unconscious.
The 51-year-old woman died in June 2009.
