he was referring to Kagan, i was referring to him.

9. Possible Filibuster?
Well, unless GOP Senators Snowe, Collins, and Brown all come out against the nomination AND are willing to support a filibuster, chances are she'll be confirmed. Democrats still have a 58-41 majority. But who knows? It seems bad luck always seems to hit us.
