13. Conyers two questions
Who created the lists and why?

When will we get the entire truthful on this matter.

For those saying move on a couple things. Matters coming to us are serious.
Most important - teh department's reputation for integrity and independence called into question.
Until we get to the bottom of this and why those doubts will persist.

Over to Mr. Smith.

Smith Opposes Subpoenas
March 21, 2007

Washington, D.C. – Judiciary Committee Ranking Member Lamar Smith (R-TX) today made the following statement regarding Democrat subpoenas for White House officials in the investigation into the firing of eight U.S. Attorneys:

“The White House is cooperating with the Committee’s investigation. They have offered to be interviewed by Members of the Committee. These subpoenas have more to do with TV coverage than uncovering the facts.

“The Committee has now met three times on this matter and looked over thousands of pages of documents. There is no evidence the White House acted improperly.

"U.S. Attorneys are political appointees and can be removed by the President at any time for any reason. The President has a right to be served by those who support his policies."

Smith: U.S. Attorneys Serve at Pleasure of the President
March 6, 2007

Washington, D.C. – Judiciary Committee Ranking Member Lamar Smith (R-TX) today issued the following statement regarding today’s hearing on U.S. Attorneys:

"U.S. Attorneys serve at the pleasure of the President and all U.S. Attorneys know that," said Ranking Member Smith. "President Clinton asked all 93 U.S. Attorneys to resign when he took office and dismissed many others during his time in office."

"Every President has to right to hire U.S. Attorneys who support their policies," he continued. "The Department of Justice had understandable reasons for dismissing each of these attorneys, none of which had to do with political retribution."

Smith concluded, "The Department has explained this to the Democrats on the Judiciary Committee. The Democrats refuse to listen, because they are more interested in partisan politics than the truth."

Edited on Thu May-10-07 08:49 AM by quiet.american
There's major evidence -- sneaking the clause into the bill so that interim USA's could be appointed without Senate approval, Sampson's emails, "we can gum this to death," Goodling taking the fifth, and the testimony of the USA's themselves.

I'm so sick of Republicans being on the side of thuggery on behalf of their party, instead of having the best interests of the country at heart.

U.S. attorneys probe shifts from Gonzales to Rove
POSTED: 7:48 a.m. EDT, May 10, 2007

WASHINGTON (AP) -- Democrats are shifting their attention on the botched firings of eight federal prosecutors from Attorney General Alberto Gonzales' fitness to head the Justice Department to the White House role in the dismissals.

In the three weeks since Gonzales testified before a Senate committee, the department disclosed that it is investigating whether his former White House liaison, Monica Goodling, weighed the political affiliations of those she considered hiring as entry-level prosecutors. Consideration of such affiliations could be a violation of federal law.

More of the eight fired U.S. attorneys also have told congressional investigators they were warned that if they publicly protested their dismissals, Justice Department officials would publicly criticize their performance.

And there have been new allegations that U.S. attorneys were evaluated on their enthusiasm for pursuing voter fraud cases that might benefit Republican candidates.

121. LYING TO CONGRESSIONAL COMMITTE IS A FELONY...under 18 USC 1001 UNDER OATH OR NOT.
OK...I feel better now...except isn't THAT how Ollie North didn't pay for his crimes? HE WASN'T UNDER OATH WHEN HE TESTIFIED?

It makes no difference whether the AG was under oath or not. Lying to a Congressional committee is a felony -- under 18 USC 1001 -- whether you're under oath or not. (If you're under oath & lie, you could also violate 18 USC 1621.)

TITLE 18 > PART I > CHAPTER 47 > § 1001 Prev | Next

§ 1001. Statements or entries generally
How Current is This?

(a) Except as otherwise provided in this section, whoever, in any matter within the jurisdiction of the executive, legislative, or judicial branch of the Government of the United States, knowingly and willfully—
(1) falsifies, conceals, or covers up by any trick, scheme, or device a material fact;
(2) makes any materially false, fictitious, or fraudulent statement or representation; or
(3) makes or uses any false writing or document knowing the same to contain any materially false, fictitious, or fraudulent statement or entry;
shall be fined under this title, imprisoned not more than 5 years or, if the offense involves international or domestic terrorism (as defined in section 2331), imprisoned not more than 8 years, or both.
(b) Subsection (a) does not apply to a party to a judicial proceeding, or that party’s counsel, for statements, representations, writings or documents submitted by such party or counsel to a judge or magistrate in that proceeding.
(c) With respect to any matter within the jurisdiction of the legislative branch, subsection (a) shall apply only to—
(1) administrative matters, including a claim for payment, a matter related to the procurement of property or services, personnel or employment practices, or support services, or a document required by law, rule, or regulation to be submitted to the Congress or any office or officer within the legislative branch; or
(2) any investigation or review, conducted pursuant to the authority of any committee, subcommittee, commission or office of the Congress, consistent with applicable rules of the House or Senate.
