27. The Problem With That Tired Wheeze You have Trotted Out, Ma'am
Is that Paul is saying in the present day he does not believe the Federal government has the authority to make dicrimination unlawful, if it is done by a property owner, and maintains this on grounds that would prevent Federal laws against child labor, enforcing a minimum wage, collective bargaining, safety regulations, and a whole host of other items. That makes what Paul says on the subject a live issue, a matter for the present day, and present concern, unlike the actions forty-five years ago of a man now very old. The fact is that the line of argument used by Paul on the subject was very common among actual opponenets of the Civil Rights Act; no person at the time who pressed that line of argument supported the passage of the Act. It is therefore a very reasonable inference that Paul, had he been called upon, would have voted against the passage of the Civil Rights Act, in company with those who pressed the argument he mantains today. The idea that he would have been an activist for civil rights is nonesense; in the present day he has had plenty of opportunities to make a name for himself in that regard, and has signally failed to do so....

The point is that whoever said he would have been shouting racial epithets really doesn't know what he "would have done." If he'd been old enough to have an opinion. And if he'd been there. Etc.

On the other hand, Robert Byrd WAS there, and he had the power to vote aye or nay, and he CHOSE to filibuster. Historical fact. Not speculation. HISTORICAL FACT.
