Elena Kagan, if nominated today, will be forced to face the press. She cannot be kept closeted not only from the public but from the inquiring minds of the media. They have a solemn responsibility to do one thing: ask her directly and openly and in front of the American people: Are you a lesbian?

A refusal to answer is a tacit admission of guilt. But she may not be able publicly to deny she’s a lesbian, likely because it’s true. She may not be able to admit it either, because it could cost her a Supreme Court post. So she’s likely to refuse to answer the question at all, and the only plausible explanation for her evasion would be because rumors of her lesbianism aren’t rumors at all but based in fact.

It’s time we got over the myth that what a public servant does in his private life is of no consequence. We cannot afford to have another sexually abnormal individual in a position of important civic responsibility, especially when that individual could become one of nine votes in an out of control oligarchy that constantly usurps constitutional prerogatives to unethically and illegally legislate for 300 million Americans.

If a battle over a "gay" nominee was going to happen regardless, why didn't he just nominate Karlan and at least get a better Justice out of it.

Here's the thing that has been nagging at me all night about this: Isn't it time for someone who will be called on to deal with the issue of equal marriage to come out of the closet, if they're in one? We've seen that closeted people are often the worst enemies of equality.

It's the 21st Century, and we're already 10% into it. Why is anybody still afraid to be who they are, especially when they've already reached a pinnacle in their career?

23. Here's the problem
If she is a lesbian and she came out now, she would never be confirmed and GLBT issues get pushed back ten to twenty years. The GOP would have the issue to glomm onto in order to block any confirmation and their base would be motivated over it as well.

It would be an utter and complete disaster that would be devestating to the Obama administration. God, guns, and gays are the meat and potatoes of the right and such a thing would destroy any possibility of her becoming an Associate Justice.

Though strides have been made, this nation remains incredibly bigoted over this issue.

Reality is a harsh mistress.

If she is lesbian and she comes out of the closet after confirmation, everything changes immediately. It would be a seismic shift on the court. It would drive a wedge between Kennedy and Scalia so deep that the rift would never be healed. Kennedy will never forgive Scalia for the insults Scalia hurled at him in the dissent to Lawrence v. Texas. Kagan would become a daily reminder of those insults.

And LGBT rights would be secured.

26. I see things differently
I don't find it impossible for her to be confirmed if she came out, it would simply require courage on the part of the same majority of Democratic Senators who voted for reconciliation on the health care bill. If you think it would take courage they don't have right now, it would be nothing compared to what happened if she were outed by someone else, and she denied it, then evidence came up practically proving it.

Being forthright and open is the only thing that has advanced the cause of civil rights in this country. Trying to prod the courts into doing something has only resulted in thirty states having the stain of predjudice inscribed upon their constitutions. Trying to be a stealth lesbian is going to have the same results.

Take away the red meat by being open and upfront, and let the goodness of the Democratic majority in the Senate do what it does. Hide in the shadows, and risk being exposed, and drive the cause of equality back even further than the fundies have gone in the time since DOMA.
