Poll question: SCOTUS poll excluding the short list - other names commonly floated
As we learn more about the top three, Garland, Kagan, and Wood, that list may change and there are other possibilities often mentioned. Which would you like to see?

Summary: False factual statements intended to sell products are commercial speech and not protected by the First Amendment. Nike was speaking not to influence a political debate, but to sell its products. If accepted, Nike's claims would endanger a vast array of consumer protection laws: cosmetics companies could lie about whether they do animal testing; tuna companies could lie about whether they catch tuna in a dolphin safe way; manufacturers could lie about whether their products were made by union labor or in the USA.

My pick would be Granholm but I doubt it will be Obamas

7. No on Klobuchar. Maybe on Napolitano or Granholm
I say no on Klobuchar because it costs us a Senate seat (Pawlenty would likely select himself, Norm Coleman, or Bachmann to fill the position)

Napolitano could be a good option. Another good option would be to move Holder onto the Court from the AG spot and install Napolitano as AG.

Like most here, I want someone under 55. Bill Clinton would be a good outside-the-box choice. Ironically, Republicans proably wouldn't put up as much of a fight as you'd expect -- given his age and heart issues, they'd take their chances. That said, I don't think he'd take the pay cut. Hillary is also older than we'd like, but would likely be a very good justice.

Also, keep in mind that the President should (and likely will) look for candidates as if he has to fill two positions. Not to be morbid, but I suspect Bader-Ginsburg will be the next to retire.

The shrewd pick won't happen. Unfortunately, neither Susan COllins nor Olympia Snowe went to law school. If either one had done so, I'd say pick her. Then dare the Republicans to mount opposition.
