Could the Tea Baggers, and those associated with them, be banned from office?

Considering they openly talk of rebellion and revolution, they would seem to be disqualified from state or federal office by the 14th Amendment


Section 3. No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

Insurrection or rebellion means open warfare. Remember that this amendment was passed right after the civil war.

3. Hey they legimately lost an election and they immediately started up
with talk of a revolution. While I appreciate the circumstances surrounding the 14th amendment it wasn't written in a manner that would require such a high standard. While I doubt this would ever take fuition, it would be nice to put those radical rethugs on their heals (so to speak).

Then the First Amendment is truly dead. That is not a country I would want to live in.

Look, it was disgusting when McCarthy did it. Why do we need to go down that path again? Do you have so little confidence in the ability to win elections fairly?

4. Not in the U.S. We all are accepting them and their views as long
as there is not a counter movement showing just as much
strength.

They have the right of free speech just as everyone does
in this country.

6. They have not committed a crime, because freedom of speech...
allows them to have their say.

Now, once convicted of a real act of insurrection, they could be banned. But just for carrying a stupid sign and having a opinion, not so much.
