If you were a prosecutor in the Scott Roeder case, what would you say to take him down?
The defense for the man accused of shooting abortion provider George Tiller is fighting prosecutors' efforts to ban the so-called necessity defense from his trial.

Defense attorneys for Scott Roeder filed a motion arguing he has a right to present his defense. Roeder has publicly said his shooting of Tiller was justified to save "unborn children."

3. The Kan. Supreme Court has already rejected this defense
There is good case law in Kan. already rejecting the necessity defense. A judge would be crazy to admit any evidence of such a defense given such case law
