Prejean made something private for someone she loved, Levi is doing something public for public consumption.

Big difference IMHO.

to give them to someone else. Not her private use at all. She made the tapes for the use of a second party, without any form of agreement that he not share them with others, one assumes. She also lied about the existence of these tapes while entering into a contract freely.
You are also forgetting her other topless photo shoot, the one where the photographer owned the negs.
