Scott Roeder has confessed to killing Dr.Tiller
AP: Man admits killing Kansas abortion doctor

Scott Roeder has confessed to killing a Kansas abortion doctor, according to the Associate Press. "The 51-year-old Kansas City, Mo., man told The Associated Press in a telephone call from jail Monday that he plans to use the so-called necessity defense at his trial," the AP reported.

Roeder told reporters that the killing of Dr. George Tiller was necessary because it protected the lives of unborn children.

1. Necessity Defense...WTF is that?
Has this been successful in the past? I would assume the Insanity Defense would be better applied here.

2. Yes, he's insane, but he's also competent
so it doesn't apply here.

So whatever defense he puts up with will meet with heavy failure.

4. The necessity defense is usually used...
...in cases where someone kills someone to stop that person killing someone else. So if I hold a gun to a child's head and you then kill me, you have the defense that you were protecting the child from harm.

I can't see this working in the case of the killing of a doctor who was not committing any crime.

6. We need to be very careful of what kind of jury is seated
One or two teabaggers/Freepers on the panel and they could hang the jury.

8. He is copy catting a defense recently used on Law and Order.
He is say he was obliged to kill Tiller to prevent a child being
killed. Treating the unborn as if born children. It is an interesting
approach. They did not win their case on Law and Order.

This shows they try every defense possible.
