4. I don't like the "without prejudice" part of the decision
That means he can shop it to another court. Dismissing with prejudice--barring him from filing it again--would have been preferable.

5. WITH prejudice would have been preferable. That's a delicious feeling
when it happens. The only time I have ever been sued (in FEDERAL court, no less, lol) I got it dismissed WITH prejudice, and did it without an attorney. The judge was one cool dude.
