Church security guards cited kissing and hugging as the "unwanted" behavior two gay men displayed before they were detained and ticketed for trespassing on a plaza near the LDS Temple, according to the police report.

Spokesmen for the Church of Jesus Christ of Latter-day Saints and the Salt Lake City police department have thus far declined to specify the behavior that prompted guards to ask Matt Aune, 28, and his partner, Derek Jones, 25, to leave the plaza at 50 E. North Temple. Aune said that the guards "slammed him to the ground" while detaining him; a guard disputed that claim, according to the police report.

Aune and Jones said they have seen heterosexual couples holding hands and kissing without incident on the plaza. Church spokeswoman Kim Farah has said the Aune and Jones were not singled out for being gay and that they were "politely asked to stop engaging in inappropriate behavior."

However, the police report does not indicate the men were given the option to stay if they stopped kissing or hugging. It states only that the guard told the men that "they need to leave property for the behavior and that is unwanted," and that the men were detained when Jones said he would not leave.

The men's detention reignited controversies over the church's efforts against gay marriage and the city's sale of the plaza to the church 10 years ago. The city had kept a public easement on the pedestrian thoroughfare but later gave it up, allowing the church to control activities on the plaza. Sunbathing and protesting now are banned.

Scores of demonstrators staged a "kiss in" to support Aune and Jones on Sunday morning near the plaza.

15. It's not funny to indirectly mock the gay community Ken because it's
not a funny situation.

Gay people shouldn't have to do shit, other than be allowed to do what everyone else in society is allowed.

11. If I find someone trespassing on my property I am not allowed to arrest them
Detain them or "issue a citation." I have to call the Sheriff's Department and then THEY will not do anything unless they witness the trespassing. Even if I identify the person who was trespassing, the Sheriff's Department will not issue a warning if they do not see the person ON my property.

I am in a different state, but I call BS on this.

Of course, it could be that private security forces are allowed to do this, but why the hell should they have more rights than the property owner unless it is a scam to force a property owner to hire those mercenaries? The next time I catch a poacher on my farm, I'll have to ask the deputy that responds if I have to hire a private security firm to protect my property rights since I am not allowed to.

13. I completely understand your outrage .. I will say that in California, a
private person (doesn't have to be a security guard), can indeed make a citizen's arrest.

However, it's a risky thing to do -- especially if it's not involving something more important than detaining someone for being on so-called private property.

Why?

Because while you may lawfully be within your rights to do so, the person you're detaining can hire a lawyer and unleash a barrage of devastating civil lawsuits against you.

So yea, the DA may not take action, but oh boy, private lawyers often see dollar signs.

26. Yeah, and when I caught a poacher, he was carrying a gun while I was not!
So I wasn't really going to try to arrest him. :scared:

But when I called the Sheriff's Department, they would not even give the guy a warning though I knew who he was and where he lived (he was a neighbor who had asked about hunting and who I refused to allow to hunt). That ended up OK - we found his tree stand, took it down and gave it away.

Then a friend in the Wildlife Law Enforcement Division offered to stake out the location. Since it was not yet hunting season, we just put the word around the neighborhood that we were going to allow the stake out and that we knew exactly who was poaching and the path they were taking from his house to where his tree stand had been. :evilgrin:

36. You sure about that?
Issuing the citation, I understand (can't do it).

But people can certainly be detained on private property by private security (or even non-security) pending the arrival of police.

For example, if someone is shoplifting in your store, you as the worker or owner can grab them and detain them I believe. And also, I'm pretty sure you can "escort" an unwilling trespasser off of private property as well (isn't that what bouncers are paid to do?).

38. The Sheriff's deputy that came said I was not allowed to detain anyone
Besides, it was a poacher with a gun so I wasn't so keen to attempt it. But even though I knew who it was and where they lived the deputy said he could not even give a trespass notice unless he (the deputy) witnessed the trespassing.

Of course, deputies really do not know the law, but if they are unwilling to enforce what I think is the las for all practical purposes, his opinion is the law.

Given that this was MORMON property, would the report also have mentioned it if one of them had been holding a latte?

31. Alcohol Is Orderless.
This was a poorly written report. A LEO should never write that he/she smelled alcohol. It should be written as intoxicating liquor or similar.

I'm not being facetious at all. It was taught in my LEO writing class and that was nearly twenty years ago. Never give a defense attorney the opening to ask "and what, exactly, does alcohol smell like".

37. I Just Told You, It's Orderless.
When writing the report you say "beer, wine, liquor, spirits" or whatever. You never say "alcohol". This is most important when showing that you had cause to administer tests in OUIL cases. You can't say "well I gave Jim a field sobriety because I smelled alcohol on his breath" because a good defense attorney will make you look like a fool.

If I gave you a glass of water, and a glass of pure ethanol, anybody with a functioning olfactory system would be able to distinguish which is which by smell alone.

swear to me that it's not the rabid anti-gay police state I accuse it of being.

Naturally, my response is always, "mmmmmmmmmmm hmmmmmmmmmmmm."

But they say there are quite a few gay people there, and the problem is not with the cops as much as it is with those fucking hate mongers over at the land of Magical Underpants.

25. I have heard there is a gay community there, mainly lesbian.
I was just commenting that it really isn't all that suprising because the overly conservative nature of that city. To be honest, I am surprised we haven't seen more. That Dateline show "What would you do?" showed people calling 911 when they encountered gay couples kissing (male only, the female couples had their pics taken by horn-dog pig males).

41. Since when can PRIVATE security put handcuffs on someone?
It is my understanding that even in department stores, if a security guard touches you, you have the right to sue. I know I sure would. Especially if they put handcuffs on me.

I heard one lady mumble that they shouldn't have done that with children nearby, as if it were obscene. And I live near one of the biggest cities in the USA, so I can't imagine Salt Lake!
