I was talking about the Kilo that Grassley kept asking about though. Not sure I agree with that one either, but she did answer the question.

19. Kilo was similar. It took place in CT. A town declared eminent domain over a private residence

and instead of using for its own purposes (which was historic for eminent domain), sold it to a private high scale home developer. We are talking about Long Island Sound property. The owner had been compensated.

This Didden case is worse. It took place here in NY, close to CT. and the town didn't even compensate the owner after the town sold his property to a drugstore chain.

Feingold said that the Congress could pass a law that was unconstitutional.

He then said it would be unconstitutional if the president gave power to another person to the conduct a war and that person would not be under the limits a president experiences. I took that to mean that a president has to answer to Congress but the president's appointee in the example would not be under that constraint. Zing!
