Ruling lets jamboree stay at A.P. Hill
ACLU ponders next move; plaintiffs argued event was equal to endorsing a religion


The National Boy Scout Jamboree can continue at Fort A.P. Hill in Caroline County, after a federal court yesterday dismissed a religious-discrimination lawsuit filed by the ACLU.

It was not immediately clear whether the ACLU would appeal to the U.S. Supreme Court.

The ACLU sued the Department of Defense on behalf of five plaintiffs, among them a rabbi and a United Methodist minister. The plaintiffs argued that, by allowing the Boy Scouts of America to hold the event on a military base, the government was unconstitutionally endorsing a religion because the BSA requires members to swear a "duty to God."

In its decision, the 7th U.S. Circuit Court of Appeals ruled yesterday that the plaintiffs lacked standing to sue the Defense Department.
