1. Not sure, but a whole lot depends on permissive you are about "in concert with"...
The law has rather precise definitions of such things. While those definitions (and the requirements embodied therein) might be annoying at the moment and in this case, they exist to protect US (you and me) from prosecutors making shit up.
2. If you supply any of the three elements of the crime. You are an accessory to that crime.
That's motive, opportunity, and ability. Operation Rescue may have provided the motive. They can be charged on that alone. But if they also supplied specific information on where and when to find him. Then they also supplied opportunity. Getting a conviction on supplying just one of the elements is iffy. But two out of three is a pretty good case.
