What if baking ingredients were sold subject to terms like a software TOS?

1. No product made from this flour shall be resold unless a royalty fee is paid to Flourtech. The royalty fee (as of the date when these terms were printed) is 20 cents per muffin, 75 cents per pie, and $1.50 per loaf of bread. For a complete and up-to-date royalty schedule, see our website. Royalty fees may be increased without prior notice.

2. This flour shall not be subject to a nutritional analysis.

3. Breaking the seal on this bag of flour constitutes agreement with these conditions. If you do not agree to the conditions, then your sole remedy is to return this bag unopened to the retailer.

4. We would prefer that you not actually return this flour to the retailer, so we're not going to scare you by listing all the conditions here. Also, the complete list of conditions runs to several pages. See our website for the complete story. Thank you for choosing Flourtech.

5. If people are willing to tolerate such onerous conditions, then obviously they must truly love our product. Or perhaps the conditions are like an initiation rite and our customers wouldn't be able to tolerate the cognitive dissonance unless they persuaded themselves that our product is excellent, even though perhaps it isn't excellent. Yeah, you never know, do you?

1. that isn't far from the Monsanto model actually

Monsanto says it doesn't matter how the contamination took place, and is therefore demanding Schmeiser pay their Technology Fee (the fee farmers must pay to grow Monsanto's genetically engineered products). According to Schmeiser, "I never had anything to do with Monsanto, outside of buying chemicals. I never signed a contract.

on edit: 6. This flour is non-transferable. Do not place in containers. Mixing with non-approved baking ingredients violates section 3 and subjects user to a one-time "This flour is not genuine" notification in the form of a latent glow-in-the-dark squid gene marker.

3. The license to use this flour is limited to use by the original purchaser.
Flourtech reserves to itself ownership of this flour, the right to determine how and on what terms the rights to the distribution of these licenses, when and if the license for this flour is being used properly and what actions Flourtech can and will take if it is determined by Flourtech that the license for this flour has been mishandled or otherwise used improperly.
