44. Bob 'Swift Boat' Perry's "Perry Homes" ...
Did Builder's Clout Trap Couple In Dream Home?

After two years of getting nowhere with their builder and warranty company, the Culls hired a structural engineer. To their chagrin, he said their house would either have to be torn down or put up on jacks, and piers driven into the bedrock. Either way, it was going to cost hundreds of thousands of dollars. The Culls hired a lawyer, and when their case went to arbitration, they were confident about the evidence.

"The only person in 12 years who has heard every bit of testimony, read all the depositions, the engineering reports and sat face-to-face with all parties for three days is the arbitrator," Bob Cull says.

The arbitrator sided with the Culls. Perry Homes was ordered to pay $800,000 in damages and retake ownership of the house. The Culls felt triumphant and vindicated. But they were about to discover that if your builder has the resources, binding arbitration isn't necessarily all that binding.

Political Ties In High Places

Seventy-six-year-old Bob Perry is one of Texas' most successful homebuilders. For the last two decades, he has used his $600 million fortune to fund the Republican revolution, both in Texas and nationally. He helped put George W. Bush into the White House. He was the Swift Boat Veterans For Truth's largest contributor. In Texas, if you hold a position of legislative, judicial or executive power, a Bob Perry donation is almost certainly in your campaign account.

After he lost in arbitration to the Culls, the builder began appealing the award through the state courts. Perry's appeals were rejected at each stop until he got to the Texas Supreme Court. And there, he got satisfaction.

"They overturn two lower courts and vacate an arbitration system — all for their biggest donor," argues Andrew Wheat.

Wheat is the research director of Texans for Public Justice, which tracks campaign contributions in Texas. Wheat says that since 2006, Bob Perry has contributed more than $21 million to political candidates and judges — including the nine Republican justices who make up the Texas Supreme Court.

"They all took money," Wheat says. "Not a single member of that court should have sat and heard a case involving Bob Perry Homes."

Six years after winning in arbitration, the Culls' $800,000 award was thrown out. In a 5-4 decision, the Court disallowed arbitration and sent the case back to the courts...

I'M NOT A PROGRESSIVE!

I was challenged as to my "Progressive" credentials on another thread (I was also called an ASSHOLE and a TOOl, but who's counting), and it did make me think about it. But really, I don't identify myself as a Progressive. I'm a Leftist. So, what's the difference? Leftism was cool because it didn't require you to suffer stupidity in the name of general tolerance. The namby-pamby world of Progressives seems to be devoid of critique, because the moment you critique something, you are suddenly being "intolerant." This is nonsense, as every Leftist knows. Now, I'm not accusing progressives of being secretly complicit with conservatism (although this is the general Left critique of such positions), but it is clear that conservatives were easily able to co-opt the discourse of tolerance and turn it against real reform, such that the legitimate struggle for gay rights is now portrayed as "intolerant" of Christian fundamentalism, and other nonsenses of this type. This is the political and rhetorical cost of the utterly vapid discourse of tolerance touted by our "progressives."

Leftism was built on critique, identified itself with critique, and had the stamina to say yes, some shit is stupid, some shit should be criticized - maybe even everything must be critiqued, ruthlessly and without "tolerance" in advance. Read Adorno and Horkeimer, read Marcuse, hell, read Debbs. You'll never see the empty notion that "opinions" should be "respected" simply because they are opinions. Rather, you see ruthless, cutting, even vicious attacks on opinions, with the following question always at stake: where do such opinions come from? Where do tastes come from? This is progressivism's greatest failure: the segregation of the "personal opinion" from the realm of political and economic power. In progressivism, the "opinion" is attached to the essence of the person (it comes from some mystical Self), and then raised to the level of a sacred entity. Hence all the wailing and moaning about "attacking my opinion," which is immediately equated to attacking the person. Leftism had none of this. The opinion, for Leftism, was a social phenomenon that was instantiated in individuals. It didn't come from the Self. Rather, it came from the social realm of political and economic power and was picked up by "selves" as a result of their placement in a dynamic social realm. For this reason, the critique of "personal opinions" is actually the critique of social power, always. The faux respect for "personal opinions," for Leftism, is complicity with social power, the failure to ask, rigorously, where opinions come from, and work on the power relations that form them.

This doesn't mean that the taste for Olive Garden is the only "opinion" to be critiqued. Leftism demands that the opposing "opinion" (which, interest of diclosure, I hold), must also be critiqued. What are the social investments in "local economies" and "authentic cultures" that drive the dislike of chain restaurants? Are these actually reactionary and nostalgic tendencies? And if you say that that's "reading into things too much," or that choice of restaurants is "off limits for critique," then you've already performed the problematic segregation: the illusion of the person segregated from the realm of political and economic power. One could, of course, go on. But the point here is simple: you will never catch me saying that opinions are beyond critique simply because they are opinions. That is the political and intellectual dead-end that progressivism leads us to, and it is all too common. Maybe I'm the one being nostalgic here, but I want some of that Leftism back. I want some of that Adorno nastiness and contempt to re-enter the political discourse. Because some things are deserving of contempt. Yes. I'm definitely NOT a progressive, and I'm damn glad for that.

My father gave me a $25 gift card to Olive Garden. My girlfriend and I went there to eat dinner, looked at the menu, and realized that $25 wouldn't cover one person.

We got up and left, went to a local restaurant, and got a large pizza with two toppings, salad bar, and beers for $27 including tip.

74. Dupont
1) Got their first military contract in 1802 from Thomas Jefferson and have been heavily on the dole since then.
2) Picked as the largest producer of air pollution in the United States in 2007.....not sure their rank right now.
3) The leader in the fight too criminalize hemp in 1937.....because hemp was their main competition for fiber production.
4) Gave Monsanto the technology that was first used in GMO production....although other methods are now used. Dupont got a sweet deal for their Pioneer seed products.
5) I'm not sure there is a company that spends more money then Dupont to project a positive image to the public.

that's just a few.....

Headon is made by a corporation. It's useless shit sold to mindless consumers. At least Oxyclean works.

125. Doe Run

http://www.huffingtonpost.com/dennis-obrien/la-oroya-a-poisoned-town_b_130448.html

La Oroya, Peru is one of the most polluted places on the planet. Situated high in the Andes, scouring acid rain has made it a moonscape. According to one recent study, 97% of the children suffer from lead poisoning. The average child in La Oroya has twice the arsenic and six times the cadmium in his blood than the average American child.

Sagaponack, Long Island has pristine beaches and some of the most beautiful homes on the planet. Even by the opulent standards of the Hamptons, one mansion stands out. Perhaps palace is a better word; Fair Field dwarfs its neighbors and mocks nature with narcissistic grandeur. It's over 100,000 feet, has 29 bedrooms, three dining rooms, multiple libraries, bowling alleys, squash and basketball courts, a $150,000 hot tub.

What do these two places, separated by 3,000 miles, have in common? They are both owned by a man named Ira Rennert.

Rennert is an industrialist in the natural resources business. He controls the Doe Run Company, which claims to be the largest company of its kind in the western hemisphere, and US Magnesium. The EPA just announced last week that they want to declare US Mag's Utah plant a Superfund site, because of 'largely uncontrolled' releases of PCBs and Dioxin. Rennert bought the metal processing plant in La Oroya, Peru in 1997.
