Guess what? I FOUND "HEATHER FROM CARD SERVICES!"
Have you been getting those scam calls from "Heather From Card Services," offering to lower your card's interest rates? Or calls that your "car's warrant was about to expire?"

You know, all those calls from spoofed Caller ID numbers from the 506 area code? Or the new ones this morning from the "100" area code? The people using the "Do Not Call" list as a "please call me" list?

Well, I've tracked them down. Thanks to a gullible operator on the call this morning (thank you! Yes, I DO need to send you something), I have all the information you need to pursue these bastards to the ends of the earth.

The company responsible for this latest round of calls is:

If you've been getting these calls, this is all the information you need to go file a complaint against them with the FTC. The bottom company is responsible for all the calls. The top company is only responsible for the most recent "card services" calls.

62. This is much more complicated than "do not call"
I was recently beset by regular rude calls offering a warranty on a car. After starting with a star69 callback number I traced the call to a call center on the east coast. Thing is, the call center leases 'cutout' lines from an umbrella organization that is in california. Unable to find good contact information on these outfits (I did have company officer names) I finally found a blurb where a relative of two of the california company officers had been their council for a few years, but was now in Beliz running a 'service' to help US citizens offshore their money into Beliz. His cell phone was listed so I called him and spoke with him for about 45 minutes.

What I learned was interesting. These companies that are calling aren't actually selling anything. There is some sort of arrangement where they get a sort of advertising kickback when people do a search on their phone number. So apparently, their goal is to irritate people enough to get them to try and locate them by phone number. This practice was described at a couple of online sites and confirmed by the attorney as ongoing and legal. His father's company (I think it was really the atty's and the father was a figurehead) buys large numbers of phones and 'sublets' them to anyone who "wants a phone line but might have trouble getting one through the normal systems".

I *suspect* it is a coordinated effort originating at the level of the company originally leasing the lines; and that they are one of those "Make money from home with your computer" outfits most of us ignore. By doing it this way they are setting up a firewall between the do not call law and themselves by setting up a large number of disposable front groups that are easily startups (with the original leasing company's help) and shut downs.

seems to have gotten through to them. Or maybe an enterprising supervisor got around to checking things and found out I got rid of all charge and credit cards in 1991.

I haven't had one of those phone calls in over a week.

These people have been calling me for more than a year.

At first, I pressed "2" and asked to speak with a sales rep. I told them I wanted off of their list. They hung up.

They called back the next day. Again, I told them not to call. More hanging up.

So, then I started just hanging up on them. Doesn't work. They continue to call back...

I even started screwing with them...telling them that I did want consolidate my credit-card debt. Why
yes...I have 46 cards...and $400k in credit-card debt..all from buying Bubble Yum. I thought they
would think that I was a waste of time. No suck luck.

I get a call from them at least twice a week.

Nothing stops these bastards.

So, you have their contact info. I'm impressed.

Since we now have their contact information, can we call them and tell them to take
us off of their list? If we know who they are, this could scare them into not calling.

How did you get this info?

Do you realize how you have improved the quality of life for millions of Americans? You're right
up their with the guy who invented car cup holder!

I got into a conversation with one of the operators and asked for the full company name and mailing address.

She asked "why? Do you need to send us something?" I said "yes." I didn't tell her it wasn't a payment but a cease and desist.

She provided the first company's contact information. Some digging and arm twisting led to the discovery of the number for the call center, and from there it wasn't that hard, with the law on my side, to find the people behind that number.

Oh, and the actual number for the four people in the call center is (813)418-5800. Don't call it unless you want to be auto-added to their call list, though.

...here's the text of a letter to send. Just plug in your information in place of mine:

Pursuant to your firm's efforts to conduct business in Vineland, NJ, I received a phone solicitation on Tuesday, March 17, 2009, from a sales representative who refused to provide her name at 12:54 PM. During the conversation I requested that your sales agent provide me with a copy of your written "Do Not Call Policy," and to place my name and phone number on the "Do Not Call" lists of the companies listed above. I was disconnected by the operator upon making those requests.

The number contacted, which is the first number in the header of this letter, has been on the “Do Not Call” List since September 26, 2003.

This letter is to formally request a copy of your company’s “Do Not Call” policy, and to demand removal of the above-captioned telephone number from your solicitation lists immediately. The policy and written confirmation of the number may be sent to the address above. Failure to provide the policy and/or remove my number from all future solicitations by your company will place you in "knowing violation" of Federal law CFR 64.1200(e)(2)(i), the Telephone Consumer Protection Act (TCPA). 19. Important to note, re: the above letter.
At least in Ca. by law, any company that calls you has to send you their Do NOt Call Policy upon your request..it can be verbal request, and they HAVE to remove your phone number from their mailing list by your request.
Here's the fun part: if they fail to do so, you can take them to Small Claims court.
In YOUR district.
doesn't matter if they live across the country.
their failure to show in court automatically gives you judgement for the claims court limit.

I used to tell this to my nuisance call people, and tell them I made my living by getting those court judgements. I got the Do Not Call Policy within days, and never got called again.

There ARE people who make money from this law and from the related Do Not Fax law.

I am sure a google will turn up relevant laws in your area.
Hell, now that we are mostly un-employed, good way to make some money, yes?

47. Also in CA, a prerecorded tele-call can NOT be the first contact
CA Civil Code:

Unsolicited prerecorded calls for the sale or lease of goods or services are banned unless a "live" operator first asks permission to play the tape. The operator must also tell the person who answers the phone the name of the caller and either the caller's address or telephone number. The operator must also ask if the person consents to hear the recorded message. Companies can use recorded messages when they contact established customers or if you have requested their call. (California Civil Code 1770(22)(A)).

If the call costs you money, cell minutes of fax paper there is , I think, a $500.00 penalty, plus, get this, attorneys fees.

I work credit card disputes and we are getting THOUSANDS of disputes for this (thanks Oprah!) They offer a free sample then charge and ship $85.00 bottles to you every moth without authorization. They operate and bill under many different name variations too. The bottom line is there is NO such thing a free! If someone requests your credit card number for ANY reason, you will get charged.

43. Yup - and they'll dodge you all day long too. They told us that they weren't able
charge us though they tried twice . . . they said to send a copy of the bank statement and they would refund in 10 days or less. That was 2 months ago. They ask for the card number for shipping. These guys are also in Florida. You also can't get a manager on the phone to save your life. Total obvious racket . . . but I bought it.:blush:

If my car wasn't 15 years old and second hand (never had a warranty) I might have had a moment of doubt. I can imagine being elderly and totally dependent on my car and terrifed of the warranty expiring.

39. If I properly recall the nuances of the Do Not Call list - and a good tool to use

You are taken off the list within a certain number of days (some telemarketers update every 90 days, but it certainly can't be more than 90).

HOWEVER if you do business with some company they, and their associates are free to now call you for "business purposes".

The proper response when they call is to simply say "Take me off your call list", see if they respond - occasionally an "okay" but usually just a disconnect.

In either case, keep track of who called (as best as you can tell, including the number from caller ID if you have it) and when. After so many violations, if you keep a log, they are subject to a fine.

The tool is WhoCalled.US at http://whocalled.us/list (to get the lookup and mapping if you so choose, of who else got called from there today) and at just WhoCalled.us (http://www.whocalled.us), the main page, you can report it and see how many other people got calls from that number and how they describe themselves and what called ID showed.

WhoCalled.us seems to maintain the database and I believe publish it to the FCC, and if you are reporting a number that is already under investigation, the FCC may contact you for more information about the call.

The area code was 064.
That's not valid in the US.

I let it roll over to the voicemail.
When I checked it a little while later, sure enough, it was Carol from Debt Solutions!

The most annoying thing to me about these scammers is the way they lie when they leave a message.
"To follow up on our previous conversation..." or "You filled out a questionnaire..." or some bullshit along those lines.
No, asshole, I've never talked to you or filled out a questionnaire about ANYTHING.
For that matter, I don't even have a mortgage, a credit card or any debt whatsoever!!!

These people are so damned stupid they just keep leaving the same message over and over again even though they've already left the same message fifty times and it's pretty obvious that they're talking to a machine. You would think they'd get the hint...

"Hmmmmm...we called this number fifty times. No actual person ever picked up. Each time we get an answering machine. What are the chances someone WILL EVER pick up? Near zero. Let's not waste time calling this number!"

They just don't get it, the idiots.

77. I do the same thing...
I have caller ID and if the caller is not a family member, someone else I know, or a local caller, I don't pick it up. I get TONS of calls from "unknown name/unknown number" or "unknown name/<insert weird wacky number from far flung places here>.

I simply never pick them up. If they leave a message and it turns out it IS someone I need to deal with, then I can call them back.

The Do Not Call Registry is/was great, but it seems that the slimeballs have all figured out ways to work around it. At first our phone was blissfully quiet (right after the inital startup), but as the years have gone by it seems we are getting just as many annoying unknown callers as we were before. It's infuriating.

82. We use caller ID too, don't know the number then don't answer the phone...
if its a legitimate call they leave a message, if they don't leave a message or aren't someone I want to speak with I block their number and never hear from them again.

84. Sorry for sounding like the Dark Ages but
How do you go about blocking a number? Do you have to call the phone company or is it sth easily done like *69?

We already screen thru Caller ID and if its unknown we let the machine pick up but just yesterday we got 3 of these car warranty calls from the same 506 number.

78. I'm putting together all the information you will need to sue them.
Right now, you can collect at least $1,500 in damages from them. The early call is $500.00, use of the robodialer is $500.00, and failure to properly identify themselves in the recording is another $500.00.

I'm putting together all the references you and anyone else will need to sue these bastards right now, and will be posting them to http://www.heatherfromcardservices.com in about 72 hours once the DNS entries go live.

Eventually, I'll start putting together boilerplate that can be adapted for people to use against this company in small claims court in your own county. And the further away from Florida that you live, the more likely you will be to get a judgment against you because they're not likely to travel to come to court in your county.

Now we start the process of taking these people down. Thanks to the people who've provided additional research here and on my own blog. We're ready to arm ourselves to take these bastards into court.

I do not recommend signing up and wish that we never did.
