On pp. 26-27:

So long as the United States does not intend for a detainee to be tortured post-transfer, however, no criminal liability will attach to such a transfer, even if the foriegn country receiving the detainee does torture him. For criminal liability to attach, the accused must be shown to have indended to effectuate the criminal object of the conspiracy. United States v. U.S. Gypsum Co., 438 U.S. 422, 433 no. 20 (1978). Thus, so long as the United States personnel who agree to transfer a detainee do not intend to effectuate the criminal object that is forbidden by the criminal torture statute - here, the torturing of the detainee - they cannot be prosecuted unded the statute. (Emphasis mine)

1. What other purpose for sending someone to a country that tortures,
can they possibly have? They had detention centers in Afghanistan and in Iraq and in Cuba. Why would they have to send people to Turkey or Saudi Arabia, or ????. What expanation could they have? I don't buy this get out of jail free card.

and then tries to say they are blameless because they were told it wouldn't happen is full of shit.

The only reason to send them to a country that is known for torture is so they can be tortured...and anyone hiding behind the "assurances given" excuse is a piece of shit coward and liar. (among other things)

Anyone claiming they didn't intend for the torture to happen after sending someone to a known torture country for "interrogation" is lying and they are just as guilty as those doing the torturing.

4. These people should be able to weasel out of prosecution
I agree. They knew these detainees would in all likelihood be tortured, and they didn't care.
