Illinois considering requiring gun owners to purchase $1M liability insurance policy
Statutes Amended In Order of Appearance
430 ILCS 65/4.5 new
430 ILCS 65/8 from Ch. 38, par. 83-8


Synopsis As Introduced

Amends the Firearm Owners Identification Card Act. Provides that any person who owns a firearm in this State shall maintain a policy of liability insurance in the amount of at least $1,000,000 specifically covering any damages resulting from negligent or willful acts involving the use of such firearm while it is owned by such person. Provides that a person shall be deemed the owner of a firearm after the firearm is lost or stolen until such loss or theft is reported to the police department or sheriff of the jurisdiction in which the owner resides. Provides that the Department of State Police shall revoke and seize a Firearm Owner's Identification Card previously issued under this Act if the Department finds that the person to whom such card was issued possesses or acquires a firearm and does not submit evidence to the Department of State Police that he or she has been issued in his or her name a liability insurance policy in the amount of at least $1,000,000 specifically covering any damages resulting from negligent or willful acts involving the use of such firearm while it is owned by such person. Effective January 1, 2010.

Illinoisans already must pay a fee to obtain an ID to exercise their Constitutional rights. Now they are considering forcing gun owners to purchase insurance in order to continue to exercise their rights.

I'm going to guess that insurance for "willful acts" cannot be obtained so it would become illegal to own a gun by default.

You're right on the money. It is against public policy to provide insurance for intentional acts. There is case law in Illinois on that very point.

So if someone breaks into my house and steals my gun while I'm on vacation and uses it in a crime, I'm liable?

22. That's the rub.
In Illinois you must have a state issued firearms owner identification (FOID) card to possess a weapon or ammo. If you let the ID expire you are a felon. So the plan is, no insurance, then no FOID, and you are now you're a felon.

9. Well, this is a fabulous idea. Illinois is on the brink of financial ruin
most of our governors are either in or about to be in prison, Cook County and the city of Chicago are selling off public assets for pennies on the dollar, and some doofus in the state legislature thinks their time is better spent violationg the Constitution.

25. Only if operated on a public road, not just to own it and keep it in the garage.
Illinois has no form of public carry permits for firearms. Plus, owning a car isn't a Constitutional right.

from where he lives it may seem like a good idea but the rest of the state? i do`t think so. there`s more effective ways to get guns out of the hands of the gangs in chicago. punishing responsible gun owners with a tax is`t going to take guns away from the bad guys. if one does have their guns stolen then they should report it immediately.

i used to own several rifles and a shotgun when i lived in the country and when i moved into town i gave my rifles to my friend and bought a guard dog.

as for illinois being a "gun grabbing state" i really did`t notice anyone out here "grabbing guns" from legal responsible gun owners...course i`m from illinois so i may not know what i`m talking about.
