I just gotta' bitch
In October of 2005 I filed chapter 13 bankruptcy. I filed complete financial statements, bank records and tax returns to back up my plan for reimbursing my creditors. I was assured by my attorney and by the court that the plan would be confirmed “in a few months”. I have been on the docket for plan approval four times and all four times the court date was moved at the last minute.

It has been 18 months and I still do not have a court date to approve a plan I’ve been adhering to all this time. I don’t know if the court will approve the plan and if they don’t what the consequences will be. Will my monthly payments go up? Will the increase be retroactive? Will the court extend the plan from three to five years? Nobody knows because it’s all at the discretion of the court on a case by case basis.

I’ve paid $60,000 into the plan, most of it from liquidated personal assets. I’ve sold everything but my dog to satisfy these people and they won’t set a date to approve the plan. My home needs work, the carpet needs to be replaced, I have two trees that pose a hazard to the structure and I can’t afford to do anything about it. If I had a confirmed plan I could rob some budget items to fix the big stuff, but if I do it now the court will assume I had the money all along and think I’m sandbagging.

I just want somebody to tell me something—anything!
