Chesapeake Bay Foundation sues EPA

Group claims federal government failed to force bay cleanup
By PAMELA WOOD, Staff Writer

The Chesapeake Bay Foundation plans to sue the federal government on Monday morning, saying the feds have abdicated their responsibility to clean up the bay.

The lawsuit will be filed in federal court in Washington, D.C., and will ask the court to order the Environmental Protection Agency to set up an enforceable plan to reduce pollution flowing into the bay.

"The lawsuit is about one thing and that is requiring EPA to enforce the Clean Water Act," said Will Baker, president of the nonprofit bay foundation, based in Bay Ridge.

Joining the foundation in the lawsuit are watermen's groups from Maryland and Virginia, the Maryland Saltwater Sportfishermen's Association and several former government officials from Maryland, Virginia and D.C.

1. my impression is EPA has spent a ton of time modeling pollution flowing to the CB
but less energy in enforcement - and all the parties in the huge watershed point the blame at one another, and want more studies before much is done.

I assume with the economic constraints there will be even more resistance to change, though if the Obama administration invest in certain kinds of infrastructure that could make a difference.

2. I came down the length of the Bay via sailboat in 05
All of the oyster business was paralyzed

They were still harvesting a few Blue Crabs, but it was pitiful

The watermen are hurting

3. Why do you think they're failing to enforce the Clean Water Act?
I'm not familiar with the bay so I don't know who or what are the big polluters.
