DU Lawyers: Does the Fair Housing Act apply to someone who's LOOKING for a room & places a want ad?
I want to put an ad up on Craigslist in their "housing wanted" section. I'm looking to move to a different city and share an apartment or house there, so I'm not advertising a room for rent. I don't give a damn about race, religion, or sexual preference, but I don't care to share a house with anyone who's got children. I like my peace and quiet, and children are the absolute antithesis of that. I would rather live with hardcore party animals than a family or single parent with children, because at least the partiers would be quiet during the day.

Does this count as an illegal discriminatory preference?

1. I'm no lawyer, so take this for what it's worth
But I don't think it would affect you. In this case you're acting as a consumer, not a service provider. As such you have the right to choose between any number of competing providers.

Let's say you want to buy a pizza and there are two places in your neighborhood. Place A you know contributes to Republicans while Place B does not get engaged in politics overtly. I'm guessing that your personal preference would move you to buy from Place B, assuming the quality of the good provided is the same at both places.

It might be uncouth to place in your ad "no children", but you can always save it for when you're talking to your prospective landlord/roommate.
