Judge tosses lawsuit over Obama citizenship
SEATTLE — A King County judge said Monday that a lawsuit challenging Sen. Barack Obama's qualifications to be president "may be a positive idea," but threw it out because the law clearly prevents the secretary of state from getting involved.

Washington's Secretary of State Sam Reed does not have the authority to inquire into Obama's birth certificate and determine if it is valid or not, said Superior Court Judge John Erlick. Therefore, Reed is obliged to accept the nomination and keep Obama's name on the state ballot, Erlick said.

Doing any external fact-finding "is not authorized by the state constitution or state law or administrative rule," he said.

Erlick dismissed the lawsuit, noting that plaintiff Steven Marquis failed to name Obama as a party to the lawsuit.

2. Give me a break...
>>Marquis further contends that Obama's birth certificate from Hawaii does not prove he is a natural-born citizen because it doesn't show the name of the hospital, a doctor's name or a baby's footprint.<<

Anyone else requested a copy of their own birth certificate recently? None of the birth certificates in our family (from two states) contain any of that information. They are all computer generated, and look very similar to Obama's.

Now - my ceremonial "certificate of live birth" has that information, but it also clearly states that it is not to be used for official purposes.

4. The original document no doubt HAS that information, but the state
Edited on Tue Oct-28-08 03:08 PM by kestrel91316
is apparently under no obligation to put it on the CERTIFIED COPY, lol. BFD.

I do genealogical research, and a certified copy of a birth record is considered THE ACTUAL RECORD for legal purposes.

On edit: I don't think there is anything in the law to prohibit someone from inspecting the actual original record ON SITE. It just can't be released off site, or probably even touched by anyone.

6. In my case, the actual original document is in my lockbox
in the family room closet. It is purely ceremonial.

At least in my daughter's case (which I remember - as opposed to mine, which is before my memory starts), the other stuff isn't part of the official record - which is the computer generated record, certified with a seal from the appropriate record keeping body.

22. zOMG11!!!11! I'm Kenyan, too!!11! I'm series!
I never knew, being the whitest one in history and all.

I'm so upset. My parents never told me. My mom has callously gone off to her birthday dinner with her sister and my dad is snickering down from heaven, leaving me to find out from the intertoobs.

I'm looking at my original, state-issued birth certificate, and none of that information is on it, either, though it plainly states "Commonwealth of Virginia" and even has an official notary crimp. Fifty-one years, and now I find out from a total stranger I'm a muslin. I'll never live it down. I read it on the internest, so it must be true!!11!

Does this mean I can't go to family reunions to pick up wimmins any more? What if the rest of my family finds out I'm... you know... black? Does this mean I have to wear a burqa now? I mean, wearing black before 7 is sort-of declassé and those things don't come in cocktail-length. And I don't have any good pearls to match, and I don't think nuslins are allowed anyway.

Mom, I'll get you for this. I knew you always loved my brother better.

Oh, those lying, crafty devils, those Virginians. Next thing you know, they'll be admitting Hawaii to the union or somethin'.

12. as it happens i have just recently received certified
Edited on Tue Oct-28-08 04:23 PM by barbtries
copies of mine and my son's - so, looking at my son's, the name of the hospital and the attending physician are on the certificate. born in 1992, no footprint. on mine - born in 1955 - we were both born in los angeles county, same hospital - the hospital's name and address appears as well. both are signed by the attending physicians and the registrar. my father signed mine and i signed my son's.

i think the information contained on the birth certificate is probably decided by either the state or the county.

had to add: i believe that as the child of an american citizen it doesn't matter where he was born, he's a citizen. correct me if i'm wrong on that point, but this whole issue is a NON.

13. Birth certificate records are by state
The states I am familiar with all use computer generated forms containing minimal information - no signatures at all on the official form.

Apparently because of a quirk in the law having to do with the age of his mother and the non-citizen status of his father, location of birth may decide citizenship. (If he was born outside the US, mom had to reside in the US for 3 years, I believe, after age 15 in order for him to be a citizen if dad is not a citizen.)

16. My daughter's and spouse's are on
green/aqua with the same kind of border and background texture as Obama's. Mine is prettier - on white with a yellow central design and blue around the edge. :D

17. My two kids were born in Hawai'i, and their certs look exactly like Obama's...
They were born in 1975 and 1979, and the birth certificates don't have baby footprints. They are on green paper.

I was born in California and my birth certificate lists all kinds of extraneous information, like my parents' occupations. It has my footprint. It is also white on black, which I think was whatever the photocopy mechanism was in 1947.

The content and format of birth certificates changes over time, just like the census and other documents. Freepers are idiots--but I repeat myself.

8. Unfortunately, it is only one of many lawsuits
across the country.

When my local NPR station switches to music before my drive home, the only talk stations I can get are right wing crap - which, at least keeps me awake.

I listened to this birth certificate flap ad nauseum a couple of months ago. I was tempted to call them and suggest they request a copy of their own birth certificates, just to prove the point (I know what the birth certificate of the host will look like, since he happens to have been born in the same state I was born in.) Somehow I just haven't had the energy to make the call.

Obama said at a dinner that his middle name is actually Steve.
I'm shocked.
