My friend Sarah telephoned the SOS's office today after hearing of the great news regarding the SCOTUS. She said they thanked her for her kind words as they are hearing very negative comments. SCOTUS Sides With Dems In OH Voting Case

Overruling a federal appeals court, the Supreme Court today sided with Ohio Secretary of State Jennifer Brunner (pictured) in a dispute over voter registration. The ruling could make it easier to vote for Ohioans whose voter registration information did not match up with other government records.

I want to THANK Jennifer Brunner for standing up for the voting rights of our citizens and for not giving to politically-motivated and bogus claims of "massive voter fraud".

Most people in Ohio and around the nation know this issue - particularly when brought up so close to an election by the GOP - is purely political and that it was designed to keep eligible voters from voting. It happened the same way in 2000 and in 2004 and 2006, as well. The pattern is well-known by now.

We also know that the US Attorney firings occurred because those US Attorneys would not bring bogus and unfounded charges against ACORN and other voter registration and community service organizations.

I understand that Ms. Brunner has received many very negative comments for standing up for voters' rights and I want her to know that there are those of us out here who THANK her for standing up to those who would disenfranchise thousands of eligible voters.

She has put herself in the line of fire in order to do what is right and to preserve the very foundation of our Democracy - the right to VOTE.

Thank you, Ms. Brunner.

big time in 2010. This is a critical election for her and Ohio since the SOS sits on the Apportionment Board that redraws all the districts after the 2010 census...

GOP filed suit in Ohio SC yesterday seeking no opening of absentee enclosing envelopes until those from voters who registered since 1/01/08 are verified. http://www.dispatchpolitics.com/live/content/local_news/stories/2008/10/17/brunner_scotus.html?adsec=politics&sid=101

Specifically, the lawsuit asks the Ohio Supreme Court to require Secretary of State Jennifer Brunner to order county elections boards not to count any absentee ballot from voters registered after Jan. 1 without first checking the statewide voter registration database to ensure there is no mismatch. (Dispatch, 10/17/08)

Note that’s only voters who have registered since 1/01 AND requested absentee.

I’m not sure what is actually going on with the state database. It’s manual indicates that notices of mismatch are sent to local BOEs (quoted in the 6th Circuit’s 3-judge panel decision, around 10/10). That would appear to jive with HAVA and Ohio law. BUT in Brunner’s memorandum in support of stay filed earlier with district court (ORP v. Brunner) she states:

that the previous Secretary of State, in June of 2006, decided to reprogram the Statewide Voter
Registration Database so that various error notifications from BMV's non-matches or
mismatches were not automatically sent to the boards of elections. Worley Affidavit.

Notification turned off by Blackwell prior to his run for Governor?

Brunner had asked for evidentiary hearing in District; denied.
