In uniform military allowed in political advertisements?

In uniform military allowed in political advertisements?
A few weeks ago I seen a candidate for the vacated house seat in my district had a photo of him with some military personnel on his campaign website. I didn't think it was an appropriate picture at the time but let it fly until I ran across this http://fundamental-truths.blogspot.com/2008/09/oh-07is-austria-putting-military.html">article earlier today. Now I am curious if this candidate is breaking election laws and/or endangering these soldiers well being? Please enlighten me if you know anything about this subject.

5. According to the article, a soldier may not
engage in political activity when in uniform. However, if this is a candid shot, and the soldier is not engaging in political activity, it appears to be okay. You see soldiers in photos with candidates all the time, so I suspect this is a candid shot the candidate is using to his benefit.

6. I don't know how candid it is
since the soldiers are talking with a state representative in front of the Ohio State House. But thanks for taking time to look over the article.

It got kicked into our heads pretty often.

Uniforms appear legit.
