Wisconsin Law Bans Sex with Dead

MADISON, Wis. — Wisconsin law bans sex with dead bodies, the state Supreme Court ruled Wednesday in reinstating charges against three men accused of digging up a corpse to have sex with it.

The court waded into the grisly case after lower court judges ruled nothing in state law banned necrophilia. Those decisions prompted public outrage in Wisconsin and on the Internet, where one blogger wrote: "Doing the dirty with the dead OK in Wisconsin."

Joking. Many state laws used to have ridiculous exceptions to rape laws, including that the victim must have "resisted to the utmost".

In Missouri up until 1978 it was impossible to rape a prostitute; the victim had to be "of previously chaste character".

7. Technical question (Not a how to!)

Per your post, a law was established after a crime had been committed but it wasn't a law when the incident occurred? How could anyone be charged with a crime which wasn't a crime when it was committed?

If it were a family member of mine dug up there would not have been any need for a supreme court ruling.

The legal issue was whether the law encompassed dead bodies (believe it or not, there was a question about that).

The WI Supreme Court said yes, the law does apply, so they go back for trial.
