They wear their robes but leave the hoods off, the polite justices of the Supreme Court. They write decisions then issue them in a formal setting, behind the columns of a capitol monument, with a history that confers a dignity not deserved. The Court embodies the dilemma of our modern culture. The most awful acts are committed with bland justification by polite people who hide behind institutional trappings; for the sake of the few, at the expense of the many.


When a vital right is denied to any group or class of citizens, the people suffer a great loss. They must endure mean spirited laws put forward as rational policy then contend with the dual reality of apparently legitimate institutions conducting blatantly illegitimate attacks on the people. Brutal bigots and snarling attack dogs have been replaced with somnolent justices affirming the outrages of smiling politicians and the bureaucrats who follow their orders. The net result is the quiet evisceration of our most important rights in a manner that puts the people into a light trance of continual acceptance.

The affirmation of the Mississippi Constitution by the U.S. Supreme Court in Williams was followed by the spread of that document's deliberately conceived methods of voter suppression and voter disenfranchisement to states throughout the South and the nation. Poll taxes, literacy tests, and felon disenfranchisement had their origins in this document, one the Court affirmed. While detached from their historical origins, provisions of the Mississippi Constitution of 1890 are well placed in state constitutions across the country.

Election fraud has now been expanded in scope to include the nation's highest court, which has become the enemy of the people. Justice Stevens should read his own words from his dissent in Bush versus Gore:
"Although we may never know with complete certainty the identity of the winner of this year's Presidential election, the identity of the loser is perfectly clear. This is very important, and I thank you for posting it. We have a group of people who want to restrict who has access to the vote and, indeed, to the Constitution. In a democracy, people should be encouraged, rather than discouraged, to vote.

Nominated. This should be required reading, especially on DU. I hope that everyone who reads this nominates it, too.

How convenient, just in time for the Indiana primary and for the general election.

How many more laws/regulations will come forward like this before 2008 - all because the Court
gave the green light.

I hope people read the main article and get to the part about the Mississippi Constitution of 1890 or
so. That's an eye opener. That's the blue print for today - and the states don't even know it.

and Stevens was the one to speak out, now he's gone over. I saw a comment he made on voter ID a while a go, maybe a year, and thought, he can't really believe that. But here we are. We knew it would end up that way right? Congress stopped the war after the 2006 elections and the Court bent over backwards to compensate for it's terrible mistake in 2000.

and throw in an occasional suicide or twenty. If that doesn't take care of the target, they just disappear. I wonder if that's what has happened since Alito and Roberts moved into the big house. Have they corrupted the Supremes with the same MO as *? (The obvious exception is Justice Ginsberg).

rights of the people of this country, need to get a new sunglass prescription, buy a quality pair, or stop wearing them. It doesn't matter what color the glasses are, they are defective.

The cases of voter fraud are so negligible they should hardly warrant any concern. Who in their right mind would risk prosecution for one vote? It is bullshit. It is not a valid concern in any state.

We have that stupid law in effect in Michigan right now, however, if you don't have the ID, you just need to sign an affidavit that you are the person that is voting. Then you are allowed to vote. I went to vote in the primary, and the poll worker and I laughed, when she asked me for my ID. I said something along the lines of, "Oh, yeah, that's right, we have such a problem with fraudulent voters. In fact I think it's one of the biggest problems our nation faces right now, if you eliminate all the other problems, like fraud, the war, and the lack of transparent voting." Maybe she was just being condescending, or maybe not. It is still a bullshit, unnecessary, and intimidating tactic. I know they published the ID "law", but I'm not sure the affidavit part of it was as widely publicized. And rumors are very powerful.


Finally, a "compromise" emerged. Tilde withdrew his claim on the presidency in return for a promise by Hayes to withdraw federal authority from the South. This ended the participation of black citizens in elective politics as voters, candidates, and office holders. During Reconstruction, blacks voted in large numbers, won elective office, and served at all levels of government. This multi-cultural democracy ended just a few years after the compromise when white domination returned to the South.

Well, that worked out well. :sarcasm:

This is a really good piece, Michael. There are so many people that are aware of what is going on in our Republic, but so many more that are not. I don't know how you make more people aware of what is theirs if they want it, but is easily lost if they don't protect it. I know election reform has made progress, and it is thanks to folks like you that it has.

The Compromise of 1877 is one of the key turning points in our history (the other being Nathaniel Bacon's untimely death before he could get the job done).

We're alone, which we knew already. But Stevens, Mon Dieu!

This wedge issue - racism - had its origin in the FIRST American rebellion, lead by Bacon in Virginia. Blacks and whites fought together. Gov. Berkeley, displaced by the rebellion, returned, took over again and instituted lifelong slavery and other measures to divide poor whites and blacks. It's been a project of the "rulers" ever since. The should be ashamed but that's not possible, they have no shame.

Only one fear was greater than the fear of black rebellion in the new American colonies. That was the fear that discontented whites would join black slaves to overthrow the existing order. In the early years of slavery, especially, before racism as a way of thinking was firmly ingrained, while white indentured servants were often treated as badly as black slaves, there was a possibility of cooperation. As Edmund Morgan sees it:

"There are hints that the two despised group (swhite & black indentured servants) initially saw each other as sharing the same predicament. It was common, for example, for servants and slaves to run away together, steal hogs together, get drunk together. It was not uncommon for them to make love together. In Bacon's Rebellion, one of the last groups to surrender was a mixed band of eighty negroes and twenty English servants."

As Morgan says, masters, "initially at least, perceived slaves in much the same way they had always perceived servants... shiftless, irresponsible, unfaithful, ungrateful, dishonest..." And "if freemen with disappointed hopes should make common cause with slaves of desperate hope, the results might be worse than anything Bacon had done."

We gave up too much ground with Alito. Way too much.

I strongly advocate impeaching Scalia for his refusal to recuse himself in the Cheney energy task force decision.

It's simple, every American can understand it, the judge had a sleepover with the defendant while he was hearing the case.

I don't know how the Republicans would defend his behavior. I think they would have to convict him. It's too simple.

24. Almost all of them need to go. Or the next Pres can appoint five or six new Justices

That was stopped when Roosevelt tried to do it. But times are different. There's no sanctity to the 9 - it can be 99;)

spyware programs block TinyURL because people often use it to disguise links to spyware/malware sites. You can tell your spyware program to allow TinyURL, but you have to be aware that there's always a possibility it will link to a spyware site ... so you must use your own judgment on a case-by-case basis.

autorank has been a DU member for several years and I doubt that he's trying to infect us with a bad link. :-)

However, I have not been able to reach the sites in question, and the Anti-Spyware says that it blocked a program from being loaded. For the record, it is a Beta. This was its first bug.

It was also very late at night and I should have gone to bed. When finally went, I did think that actually your computer might have been subverted instead, since I saw that you had posted so often.

I've followed up today with other checks about tinyurl. It's safe, and has been operating since 2002, and all of its linked sites are safe.

I apologize. It was a mistake, and an honest one.

33. I was having a conversation with my mother in law... She lives in
NC... and she was expressing her desire for Obama to become the President. It surprised the heck out of me. But I think she captured the essence of the difference between Obama and Clinton/ McSame.. he makes it ok to stop hating. People are tired of looking around the corner and fearing everyone from the man with a turban sitting next to you on a plane to the next door neighbors who happen to be gay.. Its been 8 long draining years of hatred and fear.. People are just tired of it. It corrodes the soul and makes you tired. People want to be positive and they want this dark cloud called Bush and right-wing nuts to blow away.

Now, I'm not for much of his "policy", but I think he's willing to learn and modify. The one good thing about the Dem primary being extended this far out is that he has gone to the diff. states.. he has heard real people and their concerns. I'm hoping he jumps onto a much more progressive platform once he has the Dem nomination sealed up.

35. I think the bigot faction is much reduced.
A lot of people voting for Clinton will vote for Obama. The racial smears have not yet peaked. There
is real ugly stuff out there about Obama that they'll surface but the "blowback" will be crushing.

They're trying to lop off 5% or more of the minority/poor vote with this voter ID nonsense but that
can be overwhelmed by people who don't vote coming out and voting. I expect Obama to win and then
get a lot of pressure to produce. He can't be the same old nonsense do-nothing leader we've had over
and over. 800 military installations overseas? Why? He has to do something about that. Out of Iraq
now. That's pressure. But the election piece will determine a lot of this. Obama has been screwed
by his supposed friends, e.g., Lieberman, enough to get the message. We the people are better
partners than any of "them".
