Who Would Be Liable.....



.....Hypothetical...

Your on an Airplane and your Laptop is out and you are doing some activity on it......so??????

1.....The PAX sitting next to you child throws a glass of water and it shorts out....

2.....The PAX in front of you reclines their seat and the top of the seat catches your screen and bust your screen....


So who would be liable for the damages.....Yourself.....The PAX.....or the Airline??????

2. Seems like you would be taking an 'assumed risk'.



You should be aware you are in cramped quarters and the decision would be entirely yours to use your laptop or not under those conditions.

4. A plane is a Common Carrier, strict liability kicks in.

Thus it is the Airlines responsibility. Most Airlines don't leave this get to court, they settle before it hits the Jury, but you may have to file.

Furthermore they only have to pay you its value when it was damaged, NOT what it cost you new, or to replace it.

Please note this is on domestic flights only, international flights are govern by the Warsaw Convention which sets the price Airlines must pay on international flights.
