Is the Administration saying it can break US Law as long as it isn't done on american soil?

Is the Administration saying it can break US Law as long as it isn't done on american soil?
That appears to be what they are saying concerning the destroyed CIA tapes and the rational used to open prisons off American soil..Has anyone called them on this and could it possibly be questionable? Can the US Government violate American Law if it does it in another country? Torture though is against International Law as well as American Law..

2. Actually the foreign prisions area violation of the Geneva Convention.
POW's cannot be kept in a prison.
