The five-man, five-woman jury held Sgt. Edward Hayes, three sheriff's deputies who worked as detectives under him and the estate of a fourth deputy liable for false arrest, violation of Fox's due-process rights, malicious prosecution and infliction of severe emotional distress to Fox and his wife. They also held the men liable for loss of consortium, a count brought by Fox's wife, Melissa. snip
Fox, by contrast, spent eight months in the Will County Jail awaiting trial before tests showed DNA from Riley's rape kit did not match his genetic profile. State's Atty. James Glasgow, who inherited the case, then released him.
Jurors also learned that tests on DNA found on duct tape that covered Riley's mouth matched the DNA from the rape kit and excluded Fox. That was discovered this year as part of the ongoing investigation into the still-unsolved crime. snip
Fox testified detectives did not explain his rights, ignored his request for a lawyer, misrepresented evidence, wrongly told him he failed a polygraph test, showed him a gruesome photograph of his dead daughter and threatened him with daily rape in jail unless he came up with an accident story. They promised him leniency if he came up with the story, he said.
