3. I know it's considered unconstitutional to *require* a defendant to wear prison garb for trial.
Not sure if the sentencing phase is part of that. And I don't know if Vick was required to wear the stripes, or if he just did.

(My Crim Pro class didn't discuss sentencing. That's a separate class.)

Remember that constitutional protections need to be there for the worst among us as well as the not-so-bad.

8. convicted defendants are sentenced in jail clothes all the time
The idea is to avoid prejudicing the amateur jury at trial.

13. Makes sense.
I have to admit: Last year, I watched some preliminary hearings in criminal court, and all of the defendants were in their prison clothes (in this case, orange jumpsuits and shackles). All black, and all represented by public defenders. And even though I am (somewhat) trained to look beyond the shackles, I assumed they were guilty. A lay jury would do the same thing. You just hope a judge won't.

In this case...yeah, this is completely trivial to be whining about.

9. Vick has been in jail for 3 weeks.
That's why he wore prison stripes. Turning himself in before his sentencing was the only right thing he's done in this case.

14. The picture is horrible but unfortunately it is reality.
There is another bit of good news, at least to me. Vick's house is going up for auction and he has to deposit money in an escrow account for the care of the over 50 dogs they confiscated. Sometimes the only way a point can be made is to take away a kids toys.
