The Democratic chairmen of the Intelligence and Foreign Relations committees are at odds over whether a special counsel should investigate the circumstances that led to the deletion of videotapes showing the interrogation of suspected terrorists.

While Sen. Joe Biden (Del.), chairman of the Foreign Relations panel, says it is necessary to put in place a special counsel to investigate, Sen. Jay Rockefeller (W.Va.), who chairs the Intelligence Committee, said there is no need for such a move and that a congressional probe would be sufficient at this stage.

“I think this is one case where it really does call for a special counsel,” Biden said Sunday on ABC’s This Week with George Stephanopoulos. The Delaware Democrat, who is running for the Democratic presidential nomination, said he believes the case of the deleted tapes “leads right into the White House.

“There may be a legal and rational explanation, but I don’t see any on the face of it,” he added.

Rockefeller, however, indicated that a congressional probe would be sufficient in the case.

2. Biden's right on this. With te slim favor we have in the Senate,
they need to go outside for a thorough investigation. Too many of the opposition in the Senate are Bush enablers and will roadblock any investigation that might embarrass W.

3. This is really shows who supports empire and who does not
Rockefeller, Feinstein, Kyl, et. al. seem to be enamored with empire. Biden has supported empire in the past, so I'm glad to see him calling for an independent investigation, because a 'probe' will result in nothing.

5. If I understand the process right,
a special counsel has to go through the Department of Justice since the special prosecutor law was allowed to expire in 1999. So it is just another case of the bushes examining themselves. It's a waste of time.

6. No, Fitzgerald was a special prosecutor for the Plame investigation,
wasn't he? He wouldn't give this admin a pass, and I hope there are more like him out there.

8. Special prosecutors are limited in their ability
as they can be terminated by the executive branch. An independent prosecutor is what is needed.

It means they can be stopped before getting too close. Case in point: Libby. The underlings get prosecuted, then pardoned.
